Explanation

 

1.                     Background

The City of Columbus, Department of Public Service, received a request from 200 E Fifth, LLC, owner, asking that the City allow the installation of a pedestrian bridge over a 22 foot Alley west of North Fourth Street and the first alley north of Fifth Avenue and within the public right-of-way. The proposed bridge will extend on either side of the 22 foot alley right-of-way.

The development is a proposed mixed-use development with approximately 180 residential units with commercial space and a parking garage. During the design phase of the proposed building it was determined that for safety reasons the pedestrian bridge was warranted.

The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant the aerial encroachment easement that will legally allow the installation of the pedestrian bridges to extend over the public rights-of-way of the 22 foot Alley. A value of $500.00 was established for the encroachment easement.

2.                     Fiscal Impact

There is no cost to the City to grant the easements. The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachments.

WHEREAS, the City of Columbus, Department of Public Service, received a request from 200 E Fifth, LLC, owner and located at 200 East Fifth Avenue, asking that the City allow the installation of a pedestrian bridge over a 22 foot Alley west of North Fourth Street and the first alley north of Fifth Avenue and within the public right-of-way; and

 

WHEREAS, the proposed bridge will extend on either side of the 22 foot alley right-of-way. The development is a proposed mixed-use development with approximately 180 residential units with commercial space and a parking garage. During the design phase of the proposed building it was determined that for safety reasons the pedestrian bridge was warranted; and

 

WHEREAS, the following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant the aerial encroachment easement that will legally allow the installation of the pedestrian bridges to extend over the public rights-of-way of the 22 foot Alley; and

 

WHEREAS, a value of $500.00 was established to be deposited in Fund 7748, Project P537650, as consideration for the encroachment easements where established; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of the Department of Public Service be and is hereby authorized to execute those documents necessary to grant the following described pedestrian bridge aerial encroachment easement and as depicted on the attached drawings; to-wit:

 

AERIAL ENCROACHMENT EASEMENT

BETWEEN 789.66’ TO 853.62’ ELEVATION (NAD83-2011)

0.006 ACRE

 

Situated in Quarter Township 4, Township 1N, Range 18W, United States Military Lands, City of Columbus, Franklin County and being part of a 22-foot-wide alley way as dedicated in E and A.E. Domoney’s Subdivision in Plat Book 3 Page 88, being a 3-dimensional easement extending vertically for 63.96 feet between the elevations of 789.66 feet and 853.62 feet, the boundary of said easement being more particularly described as follows:

Beginning at a point in the south right of way line of said 22-foot-wide alley, said point being North 86° 45’ 01” West a distance of 13.80 feet from the northeast corner of Lot 8 of said E and A.E. Domoney’s Subdivision;

Thence along said south right of way line, North 86° 45' 01" West a distance of 11.00 feet;

Thence through said right of way, North 03° 14' 59" East a distance of 22.00 feet to a point in the north right of way line of said 22-foot wide alley;

Thence with said north right of way line, South 86° 45' 01" East a distance of 11.00 feet;

Thence through said right of way, South 03° 14' 59" West a distance of 22.00 feet to the Point of Beginning. Containing 0.006 acres of land and 15,478 Cubic Feet

Bearings are based on The Ohio State Plane Coordinate System, South Zone (NAD83-2011).

 

SECTION 2.  That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of the Department of Public Service executing and acknowledging any of those instrument(s) and that this ordinance shall take effect and be in force from and after the earliest period allowed by law.

 

SECTION 3. That the City will receive a total of $500.00 to be deposited in Fund 7748, Project P537650, for granting the requested encroachments.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
