Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to reimburse Franklin County Public Facilities Management for the design, installation and all related costs associated with the relocation of the City's electric lines for the New Courthouse Project. Franklin County Public Facilities Management agreed to incorporate these costs in their Common Pleas Courthouse Construction Project Contract. In an effort to facilitate downtown construction efforts being performed by the City of Columbus and Franklin County, a Memorandum of Understanding (MOU) was executed in May 2008. This MOU focused on the efforts and responsibilities of both parties associated with the installation of the County's Courthouse temporary and permanent electrical service lines.

This legislation includes a transfer of funds within the Electric Build America Bonds Fund.

To authorize the Director of Public Utilities to reimburse Franklin County Public Facilities Management for the design, installation and all related costs associated with the relocation of the City's electric lines, in coordination with Franklin County Public Facilities Management's Common Pleas Courthouse Construction Project; to authorize the transfer of $294,246.90 within the Electric Build America Bonds Fund; and to authorize the expenditure of $553,298.70 from the Electric Build America Bonds Fund, for the Division of Power and Water (Power). WHEREAS, Franklin County Public Facilities Management, incorporated the design, installation and all related costs associated with the relocation of the City's electric lines into the Common Pleas Courthouse Construction Project; and
WHEREAS, in an effort to facilitate downtown construction efforts being performed by the City of Columbus and Franklin County, a Memorandum of Understanding (MOU) was executed in May 2008; and
WHEREAS, the MOU focused on the efforts and responsibilities of both parties associated with the installation of the County Courthouse's temporary and permanent electrical service lines; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Electric Build America Bonds Fund; and
WHEREAS, it is necessary for City Council to authorize the expenditure of funds from the Electric Build America Bonds Fund; and
WHEREAS, the Division of Power and Water (Power), Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to reimburse Franklin County Public Facilities Management for the design, installation and all related costs associated with the relocation of the City's electric lines at the earliest practicable date; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be and hereby is authorized to reimburse Franklin County Public Facilities Management for the design, installation and all related costs associated with the relocation of the City's electric lines for the New Courthouse Project; in the amount of $553,298.70;
Section 2. That the City Auditor is hereby authorized and directed to transfer $294,246.90 from within the Electric Build America Bonds Fund | Fund No. 559 | Div. 60-07 | OBJLVL3: 6625 | Division of Power and Water (Power) as follows:

Section 3. The for the purpose of reimbursing Franklin County Public Facilities Management for the design, installation and all related costs referenced herein, the expenditure of $553,298.70 is hereby authorized from within the Electric Build America Bonds Fund | Fund No. 559| Div.: 60-07| New County Courthouse | Proj.No. 670791-100000 | OCA Code 559791 | OBJLVL3: 6625.
Section 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
Section 5. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
Section 6. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 7. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
