Council Variance Application: CV25-019

 

APPLICANT: RFAM 2585C Properties, LLC c/o Jeffrey L. Brown, Atty.; 37 West Broad Street, Suite 460; Columbus, OH 43215.

 

PROPOSED USE: Exterior storage of automobile parts.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one parcel developed with an automobile dealership and service facility in the L-C-4, Limited Commercial District as approved by Ordinance #0984-2013 (Z12-061), passed on May 6, 2013. The existing L-C-4 district allows limited C-4 uses, and includes text commitments to setbacks, building height, traffic access, landscaping and underground utilities. The requested Council variance will allow exterior storage of automobile parts within storage containers in a designated area as depicted on the submitted site plan. The variance is necessary because storage uses are prohibited in commercial districts. Since the proposed storage is an accessory use to the existing automobile dealership and service facility, will be located within storage containers, and placed in an area on site that is mostly hidden from view, staff is supportive of the request.

To grant a Variance from the provisions of Section 3356.03, C-4 permitted uses, of the Columbus City Codes; for the property located at 2585 BILLINGSLEY RD. (43235), to allow exterior storage of automobile parts in the L-C-4, Limited Commercial District (Council Variance #CV25-019).

 

Body

 

WHEREAS, by application #CV25-019, the owner of the property at 2585 BILLINGSLEY RD. (43235), is requesting a Council variance to allow exterior storage of automobile parts in the L-C-4, Limited Commercial District; and

 

WHEREAS, Section 3356.03, C-4 permitted uses, does not allow storage uses, while the applicant proposes external storage of automobile parts within shipping containers in a designated area as depicted on the submitted site plan; and

 

WHEREAS, the City Departments recommend approval because the requested variance will allow the placement of storage containers for automobile parts inventory at an automobile dealership and service facility, limited in size and location, and not visible from Billingsley Road; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Zoning Clearance for the proposed use; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 2585 BILLINGSLEY RD. (43235), in using said property as desired; and

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Section 3356.03, C-4 permitted uses, of the Columbus City Codes; is hereby granted for the property located at 2585 BILLINGSLEY RD. (43235), insofar as said section prohibits exterior storage of automobile parts within shipping containers in the L-C-4, Limited Commercial District; said property being more particularly described as follows:

 

2585 BILLINGSLEY RD. (43235), being 4.8± acres on the south side of Billingsley Road, 1,485± feet east of Sawmill Road, and being more particularly described as follows:

 

DESCRIPTION OF A 4.907 ACRE TRACT

AT 2585 BILLINGSLEY ROAD

 

Situated in the State of Ohio, County of Franklin, Township of Perry, part of Lot 9 of Tuller’s Survey, in Quarter Township 1, Township 2 North, Range 19 West, United States Military Lands, and being a portion of a 5.010 acre tract of land conveyed to Billingsley Properties LLC, by deed of record in Instrument 201112280169814, all references being to the Recorder’s Office, Franklin County, Ohio, and bounded and described as follows:

 

Beginning, for reference, at a point in the northerly Limited Access Right-of-Way Line of Interstate 270 at 150.00 feet left of centerline station 715+50.65, as shown upon sheet 15 of 23, of the Ohio Department of Transportation Centerline Survey Plat for FRA-270-10.33 N, and at a corner of an original 2.100 acre tract of land conveyed, as Parcel II, to Storage Equities/PS Partners III - Mid-Ohio, by deed of record in Official Record 5763, Page J 06;

 

Thence N 85 deg. 33’ 08” E along a portion of a northerly Limited Access Right-of-Way line of Interstate 270 and along a portion of a southerly line of said original 2.100 acre tract a distance of 172.95 feet to a point at the southwest corner of a 10.132 acre tract of land conveyed to 2539 Billinsley Road LLC, by deed of record in Instrument 200303040063578;

 

Thence N 02 deg. 46’ 26” E crossing said original 2.100 acre tract and along a portion of the west line of said 10.132 acre tract a distance of 68.34 feet to a point at the southeast corner of said 5.010 acre tract, at a southwest corner of the Corporation line of the City of Columbus, established by Ordinance No. 1427-74 and recorded in Miscellaneous Record 163, Page 600 and at the true place of beginning of the tract herein intended to be described;

 

Thence N 87 deg. 15’ 27” W along a portion of the northerly line of said original 2.100 acre tract and along the south line of said 5.010 acre tract a distance of 223.76 feet to a point at the southwest corner of said 5.010 acre tract, at the southeast corner of a 5.0 acre tract of land conveyed to The Ohio Bell Telephone Company by deed of record in Deed Book 3556, Page 408 and at a northeast corner of the Corporation line of the City of Columbus, established by Ordinance No. 0008-2005 and recorded in Instrument 200503100043764;

 

Thence N 02 deg. 46’ 26” E along a west line of said Corporation line of the City of Columbus, established by Ordinance No. 0008-2005 along a portion of a west line of said 5.010 acre tract and along a portion of the east line of said 5.0 acre tract a distance of 955.45 feet to a point at a corner of said Corporation line of the City of Columbus, established by Ordinance No. 0008-2005;

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for exterior storage of automobile parts within shipping containers, accessory to an automobile dealership and service facility, and/or those uses permitted in the L-C-4, Limited Commercial District as specified by Ordinance #0984-2013 (Z12-061). The exterior walls of the containers shall be painted the same color as the sales and service building.

 

SECTION 3. That this ordinance is further conditioned on the site being developed in general conformance with the site plan titled, “FINAL SITE PLAN,” dated May 1, 2025, and signed by Jeffrey L. Brown, Attorney for the Applicant. The plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plan shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Zoning Clearance for the proposed use.

 

SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
