Explanation

1.  BACKGROUND

This legislation authorizes the Director of Public Service to modify and increase the construction contract with Gudenkauf Corporation for the Traffic Signal Installation - Columbus Traffic Signal System Phase A project in an amount up to $102,884.32. 

 

The modification will allow for the incoporation of additional utility associated work and fiber optic communication work required as part of an overall project to install conduit, pullboxes, fiber optic cable, and communication cabinets for a communication network to migrate the Columbus traffic signal system to an open architecture that can serve Central Ohio stakeholders with system connectivity and interoperability. 

 

The project will also allow for interagency data exchange for the Departments of Public Service and the Department of Technology as part of the Citywide Connectivity goal.

 

This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.  Prices for this modification were negotiated with the contractor by the Division of Design and Construction.

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Gudenkauf Corporation. 

 

2.  CONTRACT COMPLIANCE

Gudenkauf Corporation 's contract compliance number is 310908234 and expires 5/27/12.

 

3.  FISCAL IMPACT

This modification will be partially funded by the Department of Technology in the amount of $99,930.00.  The remainder will be funded by a Congestion Mitigation Air Quality (CMAQ) grant in the amount of $3,494.32.  The DOT funds will be transferred to this grant and the total modification will be appropriated and authorized to be expended.

 

4.  EMERGENCY DESIGNATION

The Department of Public Service is requesting City Council to enact this legislation as an emergency measure, in order to allow for the execution of this construction contract modification, in order to provide for the additional work needed for this project and maintain the project schedule.

To authorize the Director of Public Service to modify and increase the contract for the construction of the Traffic Signal Installation - Columbus Traffic Signal System Phase A project with Gudenkauf Corporation for the Division of Design and Construction;  to authorize the transfer of funds within and between the Information Services Capital Improvement Fund and the Fed-State Highway Engineering Fund; to appropriate and authorize the expenditure of $102,884.32 from the Fed-State Highway Engineering Fund for the Division of Design and Construction; and to declare an emergency ($102,884.32).

 

Body

WHEREAS, contract no. EL010746 was authorized by ordinance no. 0815-2010, passed by City Council June 21, 2010, executed August 6, 2010 and approved by the City Attorney on August 11, 2010; and

 

WHEREAS, the Department of Public Service has determined it to be in the City's best interest to modify the subject contract for purposes of incorporating additional utility associated work and fiber optic communication work required for this project; and

 

WHEREAS, this ordinance authorizes the first modification to the Traffic Signal Installation - Columbus Traffic Signal System Phase A contract in the amount of $102,884.32; and

 

WHEREAS, the total contract amount including this modification is $5,623,110.77; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that the contract should be modified and increased  immediately so that the project may be proceed on schedule, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL010746, with Gudenkauf Corporation, 2679 McKinley Avenue, Columbus, OH 43215, by $102,884.32 for additional work in accordance with the terms as shown on the modification on file in the Office of Support Services, which are hereby approved.

 

SECTION 2.  That the transfer of appropriation in the amount of $99,390.00 be authorized within the Information Services Capital Improvement Fund 514, as follows:

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
