Explanation

 

BACKGROUND:  This legislation authorizes the Finance and Management Director to modify and renew a contract on behalf of the Facilities Management Division with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials for City facilities under the purview of the Facilities Management Division.

 

Bids were solicited via RFQ026935 March 2024 and allowed four (4) renewals.  Ord. 0498-2024 authorized the initial contract, $430,030.00.  Ord.3260-2025 authorized the first (1st) renewal, $130,000.00.  This legislation seeks to authorize the second (2nd) of the four (4) renewals.   

 

1.                     Amount of additional funds:  The total amount of additional funds needed for this modification and renewal is $400,000.00

2.                     Reason additional funds were not foreseen:                     The need for additional funds was anticipated at the time of the original contract.  This is a planned modification and renewal as per the original Ordinance 0498-2024.

3.                     Reason other procurement processes were not used:                     The City currently works with Ohio Technical Service for these services.  Regular procurement processes were utilized.

4.                     How was the cost determined:  The cost is consistent with the original contract pricing proposed in Ordinance 0498-2024.

 

Emergency action is requested to ensure that hazardous materials contract may be immediately available for services as soon as practical.  

 

Ohio Technical Services, Inc. Contract Compliance No. 31-1640431 contract compliance expiration date January 21, 2027.

 

Fiscal Impact: This ordinance authorizes the expenditure of $400,000.00 from the General Fund with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials.  $278,740.00 will be used for abatement from the Firing Range and the Crime Lab.  An additional $121,260.00 for unforeseen Hazardous Material issues that come up during Maintenance or renovations.  In 2025, $130,000.00 was expended for these services from the General Fund.

To authorize the Finance and Management Director to enter into a contract on behalf of the Facilities Management Division with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials from city facilities; to authorize the expenditure of $400,000.00 from the General Fund; and to declare an emergency. ($400,000.00)  

 

Body

 

WHEREAS, it is necessary for the Facilities Management Division to contract for inspection, testing, removal, and/or remediation of hazardous materials for facilities under the purview of the Facilities Management Division; and

 

WHEREAS, formal bids were solicited and one vendor submitted a response; and

 

WHEREAS, Ohio Technical Services, Inc. was deemed the most responsive, and responsible bidder; and

 

WHEREAS, Ordinance 0498-2024 authorized the initial contract with Ohio Technical Services, Inc; and

 

WHEREAS, Ordinance 3260-2025 authorized the first renewal of this contract; and

 

WHEREAS, it is necessary to authorize a renewal contract and the expenditure of $400,000.00; and

 

WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Facilities Management Division, in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials for facilities under the purview of the Facilities Management Division, to ensure that hazardous materials can be tested for and remediated at various City facilities without interruption, for the immediate preservation of the public peace, property, health, safety and welfare; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Finance and Management Director is hereby authorized to modify and renew a contract on behalf of the Facilities Management Division with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials for facilities under the purview of the Facilities Management Division.

 

SECTION 2.  That the expenditure of $400,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, is hereby authorized in the General Fund 1000, in Object Class 03 - Contractual Services, per the accounting codes in the attachment to this ordinance. 

 

SECTION 3. That the monies in the foregoing sections shall be paid upon order of the Director of Finance and Management, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 4.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 6.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
