Explanation
 
Pursuant to Ordinance 0115-1981 passed January 19, 1981, the Public Service Director entered into an agreement with the Franklin County Board of Commissioners that provides for the removal of snow and ice from certain city streets by Franklin County Engineering Department forces and the removal of snow and ice from certain county streets by City of Columbus Transportation Division forces.  This arrangement provides for the most efficient use of both entities' snow removal assets.  Extensive records are maintained of the costs each entity incurs on the other's roadways and subsequent to the conclusion of this activity every year, the parties "settle up" their costs.  During the winter of 2003-2004, the Franklin County Engineer performed snow and ice removal on 226.91 lane miles of city roads and the division did so on 9.2 lane miles of county roads.  The net cost to the city is $238,520.08; the City received the county engineer's invoice for this on June 7, 2004.  This ordinance provides for payment of this amount to the Franklin County Engineer.
 
The payment for the 2001-2002 winter season was $92,393.98; last year's payment for the 2002-2003 winter season was $371,324.76.
 
Fiscal Impact:  The Transportation Division budgeted $730,000.00 in the 2004 Municipal Motor Vehicle License Tax Fund appropriation.  This ordinance authorizes and expenditure of $238,520.08.
 
Emergency action is requested to provide for reimbursing the county engineer as soon as possible in the interest of good inter-jurisdictional relations.

WHEREAS, Ordinance 0115-1981 provides for the removal of snow and ice from certain city streets by Franklin County Engineering Department forces and the removal of snow and ice from certain county streets by city Transportation Division forces; and
 
WHEREAS, subsequent to the conclusion of this activity every year, the parties "settle up" their costs; and
 
WHEREAS, the net cost to the city is $238,520.08 for the winter of 2003-2004; and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Public Service Department in that it is immediately necessary to provide for the reimbursement of this expense by the city to the county as soon as possible in the interest of good inter-jurisdictional relations, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to make payment of $238,520.08 to the Franklin County Engineer for snow and ice removal services on city streets during the 2003-2004 winter season for the Transportation Division.
 
SECTION 2.  That for the purposes of making this payment, the expenditure of $238,520.08, or so much thereof as may be necessary, be and hereby is authorized from the Municipal Motor Vehicle License Tax Fund, Fund 266, Department No. 59-09, Transportation Division, Object Level One Code 03, Object Level Three Code 3375 and OCA Code 599115.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
