Explanation
 
The City of Columbus, Public Service Department, Transportation Division is engaged in the development of a comprehensive Bikeway system throughout the City.  Currently, a project is being designed to link the Alum Creek Path to the I-670 Path.  This legislation authorizes a modification to the Transportation Division's existing design contract with Burgess & Niple for the General Engineering Bikeway project.  This contract modification is necessary to update plans to current guidelines, incorporating ADA features.
 
This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.  
 
Burgess & Niple (contract compliance #31-0885550, expires December 12,  2005) was selected in accordance with Chapter 329 for professional service contracts.  We have negotiated new hourly rates for this modification because the current contract is six (6) years old.  Costs have increased by approximately three percent (3%) per year for the past eight years.  The overhead rate and percentage of profit from the original contract were used because they are still valid.
 
The original contract , EA012949-002 & 004, in the amount of $250,000.00 was authorized by Ordinance 1690-99 passed July 12, 1999, executed July 28, 1999 and was approved by the City Attorney August 3, 1999.  The contract was modified and increased by $50,000.00 for work involving the Longrifle Road traffic calming project. as authorized by Ordinance 1148-2004, passed July 19, 2004, executed on December 20, 2004 and approved by the City Attorney on January 6, 2005.  The total of all modifications including this one is $90,000.00.  The contract amount including all modifications is $340,000.00
 
Fiscal Impact:  Funds in the amount of $40,000.00 are budgeted within the Transportation Division's 2005 Capital Improvement Budget in the 1995, 1999 Voted Streets and Highways Fund in the Pedestrian Safety Improvement project and and available from the 2005 bond sale.  
 
Emergency action is requested in order for the Recreation and Parks Department to maintain the construction schedule they have established for this project. Recreation and Parks has secured a ODNR Trail Grant to pay for a portion of this project.

WHEREAS, Contract number EA012949-002 & 004 was authorized by Ordinance 1690-99 passed July 12, 1999 executed July 28, 1999 and was approved by the City Attorney August 3, 1999.  
 
WHEREAS, it is necessary to modify this contract and increase this contract by $40,000.00 per the consultant's letter dated June 7, 2005 for the General Engineering Bikeway project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately to expedite the completion of design work undertaken in connection there with, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1.  That the Public Service Director be and hereby is authorized to modify and increase Contract number EA012949-002 &004 with Burgess & Niple, 5085 Reed Road, Columbus, Ohio 43220 to complete the design, construction plans and permits for the General Engineering Bikeway project in accordance with the plans on file in the office of the Public Service Director.
 
SECTION 2.  That for the purpose of paying the cost thereof, the sum of $40,000.00 or so much thereof as may be needed be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 590105.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
