Explanation
 
Background:  This ordinance authorizes the Mayor of the City of Columbus to accept a subgrant in the amount of $36,684.07 from 16.738 Edward Byrne Justice Assistant Grant Formula Program funded through the U.S. Department of Justice Assistance, the Ohio Office of Criminal Justice Services;  authorizes the Franklin County Municipal Court, Clerk of Court  Lori M. Tyack as the official representative to undertake the day to day operations of the E-Ticket subgrant; appropriates the said amount from the unappropriated balance of the general government grant fund; authorizes the transfer and appropriation of the required matched funds of $18,314.54.   In addition, this ordinance authorizes the Director of Finance and Management on behalf of the Franklin County Municipal Court, Clerk of Court to enter into a contract with Advanced Public Safety, Inc. and authorizes the Franklin County Municipal Court, Clerk of Court to modify contract FL000868 with Maximus, Inc.; authorizes an expenditure of  $54, 998.61 from the general government grant fund for the purchase of Virtual Partner software, electronic traffic ticket units and technology interface.
The E-Ticket subgrant (2006-JG-EOV-6354), in the amount of $36,684.07 and the required matched funds of $18,314.54 will fund the acquisition of Virtual Partner software, electronic traffic ticket units and technology interface to support the E-Ticket pilot project for the Franklin County Municipal Court Clerk's office and the Columbus Division of Police. The pilot program will consist of equipping five (5) Columbus Division of Police cruisers with the ability to electronically issue traffic citations from the mobile computer in their patrol cars. The officers will be able to complete traffic citations in less than 60 seconds. The patented application captures data from the CAD/Mobile data system and auto populates an electronic version of the citation on a computer screen.  The traffic offender's information is obtained using data returned from NCIC, motor vehicle queries or their driver's license. This application will increase law enforcement officers effectiveness and efficiency through time saving techniques that link law enforcement databases to the existing Franklin County Municipal Court Clerk's computer systems, enabling the immediate transfer of data between the Franklin County Municipal Court, the Franklin County Municipal Clerk's office, the Bureau of Criminal Identification & Investigation and the Bureau of Motor Vehicles.
 
Advanced Public Safety, Inc. Bid Information:
Negotiations were conducted with Advanced Public Safety, Inc. for the best price.  Advanced Public Safety (APS) is the sole manufacturer and sole distributor of Virtual Partner Solutions and also provides the Zebra RW420 printers which include proprietary applications required for printing: wireless font downloader, citation mgmt software, & driver font printer software; therefore the Franklin County Municipal Court, Clerk of Court is requesting said purchase in accordance with sole source procurement.
 
Maximums, Inc. Bid Information:
Negotiations were conducted with Maximus, Inc. for the best price.  Due to the proprietary rights, per terms of contract number 18848, pursuant to ordinance 2807-97 approved by Council on 11/24/97, the Franklin County Municipal Court, Clerk of Court is requesting that the interface be provided from the sole source provider, Maximus, Inc.
 
The companies are not debarred according to the federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.
 
Emergency:  Emergency legislation is requested to expedite the subgrant program for the facilitation of the E-Ticket project.

WHEREAS, the Mayor of the City of Columbus was awarded a subgrant in the amount of $36,684.07 through the 16.738 Edward Byrne Justice Assistance Grant Formula Program funded through the U.S. Department of Justice Bureau of Justice Assistance, the Ohio Offices of Criminal Justice Services; and
 
WHEREAS, the Franklin County Municipal Court, Clerk of Court Lori M. Tyack shall be designated as the official representative to undertake the day to day operations of the E-Ticket subgrant; and
 
WHEREAS, the required matched funds in the amount of $18,314.54 shall be transferred from the Franklin County Municipal Court Clerk's computer fund; and
 
WHEREAS,  the pilot project consists of  equipping five (5) Columbus Division of Police cruisers with the ability to electronically issue traffic citations from the mobile computer in their patrol cars; and  
 
WHEREAS, the officers will be able to complete traffic citations in less than 60 seconds; and
 
WHEREAS,  the purchase of Virtual Partner software, electronic traffic ticket units and technology interface will  increase the law enforcement officers effectiveness and efficiency through time saving techniques that link law enforcement databases to the existing Franklin County Municipal Court Clerk's computer systems; and
 
WHEREAS, the interface will enable the immediate transfer of data between the Franklin County Municipal Court Clerk, the Franklin County Municipal Court,  the Bureau of Criminal Identification & Investigation and the Bureau of Motor Vehicles; and
 
WHEREAS, that it is necessary to modify the support contract with Maximus, Inc.: contract number FL000868, authorized by ordinance number 0112-01 and approved by Council on January 22, 2001; and
 
WHEREAS, it is in the best interest of the City and the Clerk to enter into said contracts in accordance with the sole sources provisions of Section 329.07  of the Columbus City Codes; and
 
WHEREAS, an emergency exists in the usual daily operation of the Franklin County Municipal Court, Clerk of Court in that it is immediately necessary to accept the aforementioned subgrant and enter into said contracts for Virtual Partner software, electronic traffic ticket units and technology interface, and to appropriate and transfer the necessary funds needed for the E-Ticket pilot project thereby preserving the public peace, property, health, safety and welfare; now therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That Mayor of the City of Columbus is hereby authorized to accept a subgrant in the amount of $36,684.07 from the 16.738 Edward Bryne Justice Assistant Grant Formula Program, funded through the U.S Department of Justice Bureau of the Assistance, the Ohio Office of Criminal Justice Services.
 
SECTION 2. That the Franklin County Municipal Court Clerk be and is hereby designated as the official representative to undertake the day to day operations for the subgrant number 2006 JG-EOV- 6354 in the amount of $36,684.07 from the 16.738 Edward Bryne Justice Assistant Grant Formula Program, funded through the U.S. Department of Justice, Bureau of Justice Assistance, the Ohio Office of Criminal Justice Services.
 
SECTION 3.  That the appropriation in the amount of $18,314.45 is hereby transferred as follows:
 
From:  department 2601, computer fund, fund 227, oca 260208; object level one 02, object level three 2193- $12,523.07; object level one 03, object level three 3336 - $5,791.38
To:  department 2601, computer fund, fund 227, oca 260208; object level one 10, object level three 5501- $18,314.45
 
SECTION 4.   That the amount of $18,314.45 is hereby transferred as follows:
 
From:  department 2601, computer fund, fund 227, oca 260208; object level one 10, object level three 5501- $18,314.45
To:  department 2601, general government grant fund, fund 220, oca 267001, grant 267001, object level three 0886 - $18,314.45
 
SECTION 5.  That from the unappropriated monies in the general government grant fund, and from any and all sources estimated to come into said fund and unappropriated for any other purpose during the project award period, the sum of $54,998.61 is appropriated as follows: department 2601, fund 220,  oca 267001, grant 267001, object level one - 02, object level three 2000 - $12,523.07; object level one - 03, object level three 3000 - $42,475.54.
 
SECTION 6.  That the Director of Finance and Management on behalf of the Franklin County Municipal Court Clerk is hereby authorized and directed to enter into a contract with Advanced Public Safety, Inc. for the amount of $14,858.61 for the purchase of Virtual Partner software and equipment.
 
SECTION 7.  That the Franklin County Municipal Court Clerk is hereby authorized and directed to modify the support contract with Maximus, Inc. for the amount of $40,140.00 for the purchase of technology interface.
 
SECTION 8. That the expenditure of $40,140.00 or so much thereof as may be necessary is hereby authorized to be expended from the general government grant fund, department 2601, fund  220,  oca 267001, grant 267001, object level one - 03, object level three -3000 to modify the contract with Maximus, Inc to pay costs thereof.
 
SECTION 9.  That the expenditure of $14,858.61 or so much thereof as may be necessary is hereby authorized to be expended from the general government fund, department 2601, fund 220,  oca 267001, grant 267001, object level one -02, object level three 2000 - $12,523.07, object level one - 03, object level three  3000 - $2,335.54 to contract with Advanced Public Safety Inc. to pay costs thereof.
 
SECTION 10.  That funds appropriated shall be paid upon order of the Franklin County Municipal Court, Clerk of Court and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
SECTION 11.  That the contracts were awarded pursuant to the sole sources provisions of Section 329.07 of the Columbus City Codes; and
 
SECTION 12.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
