Title: To authorize the Director of the Recreation and Parks to execute those documents necessary to enter into a lease agreement by and between the City of Columbus and The Ohio State University for the construction and shared use of a boathouse at Griggs Reservoir, within the City owned Duranceau Park, located at 3100 Thoburn Road, Columbus, Ohio 43221, to the extent they may be applicable, to waive the competitive bidding and Land Review Commission requirements of the Columbus City Codes (1959) Revised, and to declare an emergency.
Explanation
 
Background:     The City of Columbus, Ohio ("City") desires to enter into a lease agreement with the Ohio State University ("OSU") for the construction and shared use of a boathouse at Griggs Reservoir, within the City owned Duranceau Park, located at 3100 Thoburn Road, Columbus, Ohio 43221.  The City will lease to OSU 3 of the 6 bays, office space, 2 meeting rooms, and a shared common space in the boathouse.  The City will utilize the boathouse to conduct Outdoor Education Programs as well as outdoor training classes, which will be made available to both the general public and City employees.  OSU will provide the necessary funding for design and construction of the boathouse and will also share in the City's expense to operate and maintain the facility.  Both parties will be jointly involved in the selection of the architectural team and the contractor to be used for the overall design and construction of the boathouse.  It has been determined by the Recreation and Parks that the classes offered at this proposed facility will benefit the City by promoting the sport of rowing at the youth, academic, and adult levels.  The following legislation authorizes the Director of the Recreation and Parks Department to execute those documents necessary to enter into a lease agreement between the City and The Ohio State University for the construction and shared use of a boathouse at Griggs Reservoir.

Emergency Justification: Emergency action is requested in order to meet the tentative deadline of utilizing the boat house in January of 2009.

WHEREAS,      the City of Columbus, Ohio ("City") desires to enter into a lease agreement with the Ohio State University ("OSU") for the construction and shared use of a boathouse at Griggs Reservoir, within the City owned Duranceau Park, located at 3100 Thoburn Road, Columbus, Ohio 43221; and
 
WHEREAS,      the City will lease to OSU 3 of the 6 bays, office space, 2 meeting rooms, and a shared common space in the boathouse; and
 
WHEREAS,      the City will utilize the boathouse to conduct Outdoor Education Programs as well as outdoor training classes, which will be made available to both the general public and City employees; and
 
WHEREAS,      OSU will provide the necessary funding for design and construction of the boathouse and will also share in the City's expense to operate and maintain the facility; and
 
WHEREAS,      both parties will be jointly involved in the selection of the architectural team and the contractor to be used for the overall design and construction of the boathouse; and
 
WHEREAS,      it has been determined by the Recreation and Parks determined that the classes offered at this proposed facility will benefit the City by promoting the sport of rowing at the youth, academic and adult levels and therefore the lease should be allowed; and
 
WHEREAS,      an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Recreation and Parks Department to execute those documents necessary to enter into a lease agreement between the City and The Ohio State University for the construction and shared use of a boathouse at Griggs Reservoir for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That the Director of Recreation and Parks Department be, and hereby is, authorized to execute a lease in substantially the form attached hereto with The Ohio State University for the construction and shared use of a boathouse at Griggs Reservoir, within the City owned Duranceau Park, located at 3100 Thoburn Road, Columbus, Ohio 43221.
 
      Section 2.      That this Council has determined that it is in the best interest of the City of Columbus to waive and does hereby waive the requirements of Columbus City Codes (1959) Revised, Chapter 328.01 (Land Review Commission) and Section 329.29 (competitive bidding) to the extent that they may apply to this transaction with regards to this ordinance only.
 
      Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
