Explanation
 
BACKGROUND:  Need. This legislation authorizes the Director of Public Utilities to enter into an agreement with Stone Environmental Engineering and Science, Inc. for professional engineering services for the Olentangy River Road Culvert Replacement and East Fifth Avenue Stormwater System Improvements Project; to authorize the City Auditor to transfer $50,494.42 from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund. This project has been developed to mitigate frequent street and yard flooding along Olentangy River Road at Troon Trail and the East Fifth Avenue railroad underpass near Penny Street.
 
Bid Information: The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.11, "Awarding professional service contracts through requests for statements of qualifications." A notice of Request for Statements of Qualifications appeared in the City Bulletin on February 22 and March 1, 2003.  Statements of Qualifications were received on March 7, 2003.  Forty-seven consultants submitted Statements of Qualifications. Three consultants were selected to submit technical proposals for this project.  All three consultants submitted these technical proposals on July 25, 2003.
 
Upon review of the Statements of Qualifications and technical proposals, the offerors have been ranked using criteria specified in City Code, and other criteria, specifically: competence of the offeror to perform the service, past performance of the offeror, cost evaluation, the feasibility/quality of the proposed project approach, location of the office to perform the work, familiarity with local project requirements, ability to perform expeditiously, and contracted backlog of work with the Division.
 
Based upon these criteria, Stone Environmental Engineering and Science, Inc. was selected as the highest ranked offeror.

FISCAL IMPACT:  This fund transfer from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund is a temporary measure, until such time as the proceeds from the bond sale can be made available.  There is sufficient budget authority within the 2003 Capital Improvements Budget for this expenditure.

To authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Stone Environmental Engineering and Science, Inc. to provide design engineering services for the Olentangy River Road Culvert Replacement and East Fifth Avenue Stormwater System Improvements Project for the Division of Sewerage and Drainage; to authorize the transfer, appropriation and expenditure of $50,494.42 from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund and to authorize the expenditure of $50,494.42 within the Storm Sewer Bond Fund.  ($50,494.42)
 
Body
 
WHEREAS, it is necessary to authorize the City Auditor to transfer funds from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund; and
 
WHEREAS, significant flooding and other stormwater problems have been identified through customer complaints for the area covered by this project; and
 
WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into an agreement for professional engineering services to mitigate the significant flooding and other stormwater problems; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Storm Sewer System Reserve Fund, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2004, the Sum of $50,494.42, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-15| Object Level 10| Object Level Three 5502| OCA Code 901685.
 
Section 2.  That the City Auditor is hereby authorized and directed to transfer $50,494.42, from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund No. 685, into the appropriate project account as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the expenditure of $50,494.12 is hereby appropriated for the Olentangy River Road Culvert Replacement Project within the Storm Sewer Bond Fund No. 685| Division 60-15| Object Level Three No. 6682| Project No. 610751| OCA Code 685751.
 
Section 4.  That upon obtaining other funds for the purpose of funding the aforementioned stormwater system improvements project work, the City Auditor is hereby authorized to repay the Storm Sewer Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purpose.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract associate the expenditure of the funds transferred under Section 2., above.
 
Section 6. That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with Stone Environmental Engineering and Science, Inc.; 6460 Busch Blvd. Suite 105; Columbus, Ohio 43229-1737, for the Division of Sewerage and Drainage, for professional engineering services in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
 
Section 7. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
Section 8.  That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, is hereby authorized as follows:  Division 60-15, Fund 685, Project 610751, Object Level Three 6682, OCA Code 685751, Amount $50,494.42.
 
Section 9. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance shall take effect and be in force from and after the earliest date allowed by law.
