Explanation
 
In May 2007, City Council authorized Capitol South Community Urban Redevelopment Corporation ("Capitol South") to study parking in Downtown Columbus and develop recommendations to make Downtown more competitive in terms of improved parking availability, convenience, and value.  In order to meet increased parking demand resulting from new development in Downtown Columbus the study recommended that the City construct two parking facilities. In 2008, City Council authorized a Guaranteed Maximum Price Contract with Capitol South, in an amount not to exceed $26,170,871, to develop, design, and construct two parking facilities, one located at the southeast corner of Front and Rich Streets, and the other located at the southeast corner of Fourth and Elm Streets (collectively, the "Parking Facilities").  Construction of the Front and Rich Street Parking Facility is expected to be completed in late June 2009 with an anticipated opening date of July 1, 2009.  The construction of the Fourth and Elm Parking Facility should be completed in January 2010 with an anticipated opening date of February 2010.
 
This ordinance authorizes the Director of Finance and Management to enter into a management agreement with Capitol South for the operation of the two City-owned parking facilities and to waive the competitive bidding requirements of the Columbus City Codes. The agreement authorizes Capitol South to charge a fee for its services and requires Capitol South to remit to the City on a regular basis all income received from operation of the Parking Facilities, net of the expenses of operating the Parking Facilities.
 
The contract Compliance Number for Capital South/ Columbus Downtown Development Corporation is #76-0704655 (expiring 2/28/10).
 
 
Fiscal Impact:  There is no funding required.  The fee paid to Capital South under the management agreement will be funded as an operating expense and will be paid from the parking revenues generated by the Parking Facilities.
 
Emergency action is requested in order to allow Capital South adequate time to award a bid and enter into a contract with a professional parking services operator to meet the July 1, 2009 target opening date of the Front and Rich Street Parking Facility and thereby begin generating parking revenue for the City.

To authorize the Director of Finance and Management to enter into a management agreement with Capitol South Community Urban Redevelopment Corporation for the operation of the City's two Downtown parking facilities; to waive the competitive bidding provisions of the Columbus City Codes; and to declare an emergency.
 
Body
 
WHEREAS, in order to meet increased parking demand resulting from new development in Downtown Columbus, the City is currently constructing two parking facilities, one located at the southeast corner of Front and Rich Streets containing 770 parking spaces , and the other located at the southeast corner of Fourth and Elm Streets containing 682 parking spaces (collectively, the "Parking Facilities"); and
 
WHEREAS, in 2008 the City engaged Capitol South Community Urban Redevelopment Corporation ("Capitol South") to develop, design, and construct both  Parking Facilities; and
 
WHEREAS, Capital South has significant experience in managing Downtown parking operations and has extensive knowledge of the Parking Facilities and the City's requirements for their operation; and
 
WHEREAS, the City deems it desirable to engage Capitol South to manage the operations of the City's Parking Facilities; and
 
WHEREAS, Capitol South will use an RFP process to select a professional parking management company to run day-to-day operations of each of the Parking Facilities; and
 
WHEREAS, this ordinance request waives the competitive bidding provisions of the Columbus City Codes, 1959; and
 
WHEREAS, an emergency exists in the usual daily operation of the City if Columbus in that it is immediately necessary to authorize the Finance and Management Director to enter into an agreement for the management of the Parking Facilities thereby preserving the public health, peace, property, safety, and welfare; now, therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.      That the Director of Finance and Management be and hereby is authorized to execute and deliver an agreement with Capitol South that would (a) engage Capitol South to manage the City's two Parking Facilities, (b) permit Capitol South to charge a flat fee for its services against the Parking Facilities operating expenses, and (c) require Capitol South to remit to the City on a regular basis all income received from operation of the Parking Facilities, net of the expenses of operating the Parking Facilities, and to otherwise effect the intent of this Ordinance.
 
SECTION 2.      That it is in the best interest of the City of Columbus to waive the competitive bidding provisions of the Columbus City Codes, 1959, and such provisions are hereby waived.
 
SECTION 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage, if the Mayor neither approves nor vetoes the same.
