Explanation
 
1.      BACKGROUND:
 
A.  Need.  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Dreier & Maller, Inc. for the Clintonville Private Source I/I Project for the Division of Sewerage and Drainage.  Work to be completed by this contract consists of the installation of approximately 100 private sewer laterals utilizing the Cured-in-Place Pipe (CIPP) process including installation of cleanout, point repairs, and lateral tap lining.  The work under this contract shall be completed in a manner acceptable to the City within 270 calendar days after the effective date of the Notice to Proceed.
 
The contract was advertised in the City Bulletin, and bids were received on August 27, 2008, as follows:
 
1.  United Survey, Inc. | Majority Firm | $898,356.00
2.  Dreier & Maller, Inc. | Majority Firm | $1,250,160.00
The Engineer's construction cost estimate was $912,420.00
 
The apparent low bidder, United Survey, Inc., did not provide the necessary Sewer Tapper's License Number or list of subcontractors as required under section M-5.  Also, the apparent low bidder's attachments for Section HE-12 did not provide the necessary information requested of the bidder.  These omissions by United Survey, Inc. resulted in their bid being deemed non-responsive.
 
Award is recommended to the lowest and best bidder.
 
B.      Contract Compliance No.:  34-1681027 (MAJ) (Expires 5/29/2010)
 
C.    Emergency Designation:  No emergency designation is requested for this legislation.
 
 
2.      FISCAL IMPACT:
 
This ordinance authorizes the transfer of funds from within the Sanitary Sewer Revenue Bonds Fund for this expenditure. Also, the 2008 Capital Improvements Budget is amended to provide sufficient authority for this expenditure upon passage of this ordinance.

Body
 
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it necessary to enter into a construction contract with Dreier & Maller, Inc., in order to provide for the construction of the Clintonville Private Source I/I Project; and
 
WHEREAS, it is necessary to authorize the transfer of funds within the Sanitary Sewer Revenue Bonds Fund to provide sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize an amendment to the 2008 Capital Improvements Budget for the purpose of providing sufficient budget authority for the aforementioned project expenditure; and
 
WHEREAS, it is necessary for City Council to authorize the expenditure of funds from the Sanitary Sewer Revenue Bonds Fund; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to execute a construction contract with Dreier & Maller, Inc., in connection with the Clintonville Private Source I/I Project, at the earliest practical date; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to enter into a contract with Dreier & Maller, Inc., 6508 Taylor Road SW, Reynoldsburg, OH 43068, for construction of the Clintonville Private Source I/I Project in accordance with the terms and conditions as shown in the contract on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That the City Auditor is hereby authorized to transfer and appropriate $1,250,160.00 within the Sanitary Sewer Revenue Bonds Fund, Fund 665; Object Level Three 6630; Division of Sewerage and Drainage; Div. 60-05:

Section 3.  That the 2008 Capital Improvements Budget Ordinance No. 0690-2008 is hereby amended as follows, to provide sufficient budget authority for the award of the agreement stated herein.

Section 4.  That for the purpose of paying the cost of the construction contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-05; Fund 665; Clintonville Private Source I/I, Project No. 650405.2; Object Level 6630; OCA Code 665405; Amount $1,250,160.00.
 
Section 5.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 8.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
