Explanation

 

AN04-015

BACKGROUND:                     This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN04-015 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since July 15, 2004, the date of receipt from the Board of County Commissioners of Franklin County.

 

These are submitted in accordance with the Ohio Revised Code.

 

FISCAL IMPACT:                     Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.

 

Title

 

To accept the application (AN04-015) of William L. & Jean A. Folk, et al. for the annexation of certain territory containing 23.3 ± Acres in Plain Township.

 

Body

 

WHEREAS,   a petition for the annexation of certain territory in Plain Township was duly filed by William L. & Jean A. Folk, et al. on May 27, 2004; and

 

WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated July 6, 2004; and

 

WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on July 15, 2004; and

 

WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and

 

WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore, 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

 

Section 1.  That the proposed annexation as applied for in the petition of William L. & Jean A. Folk, et al. being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio May 27, 2004 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated July 6, 2004, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:

 

Situated in the State of Ohio, County of Franklin, Township of Plain, located in Section 2, Township 2, Range 16, United States Military Lands, being those tracts as conveyed to William L. and Jean A. Folk by deed of record in Official Record 14340F68, Plain Township Board of Trustees by deed of record in Deed Book 3271, Page 235, James M. and Deidre A. Norris by deed of record in Official Record 14126G08, Johnnie M. and Carolyn Bowman, a portion of central College Road and a portion of Harlem Road;

 

                     Beginning at the intersection of the southerly right-of-way line of Central College Road with the westerly right-of-way line of Harlem Road, being in the existing City of Columbus Corporation Line by Ordinance No. 2506-85 and of record in Official Record. 6886A13;

 

                     thence westerly with said southerly right-of-way line, and said existing City of Columbus Corporation Line, a distance of approximately 399 feet to a point;

 

                     thence northerly, across Central College Road, a distance of approximately 67 feet to a point in the northerly right-of-way line of said Central College Road;

 

                     thence easterly, with said northerly right-of-way line, a distance of approximately 2078 feet to a point;

 

                     thence southerly, across Central College Road and being the existing City of Columbus Corporation line by Ordinance No. 5-99 and of record in Instrument Number 199906140150467, a distance of approximately 80 feet to a point in the southerly right-of-way line of said Central College Road;

 

                     thence westerly, with said southerly right-of-way line and existing corporation line, a distance of approximately 696 feet to a point in the easterly line of said Bowman tract;

 

                     thence southerly,  with said Bowman tract, and the existing corporation line, a distance of approximately 886 feet to a point in the existing City of Columbus Corporation line by Ordinance No. 723-99 and of record in Instrument Number 199909200237689 and being the southeasterly corner of said Bowman tract;

 

                     thence westerly, with the City of Columbus Corporation line, the southerly lines of said Bowman tract, Norris tract and Folk tract and across Harlem Road right-of-way, a distance of approximately 975 feet to a point in the existing City of Columbus Corporation line by Ordinance No. 2506-85 and of record in Official Record 6886A13 and being the westerly right-of-way line of said Harlem Road;

thence northerly, with the westerly right-of-way line of said Harlem Road and existing City of Columbus Corporation line, a distance of approximately 909 feet to the Point of Beginning, and containing approximately 23.3 acre of land more of less.

 

Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

 

Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
