Explanation
 
Background:  The Public Service Department, Transportation Division is planning to replace the South High Street bridge over railroad tracks just north of SR 104.  This legislation authorizes a modification to the existing design contract with Barr Engineering, Incorporated, to add 250 feet of sidewalk to the south of the bridge.  This sidewalk is presently missing and/or in a deficient condition.
 
This modification is an addition to the original scope of services but is a continuation of the existing work being performed and is not practical to contract with a different consultant.
 
The current hourly rate, overhead rate, and percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification.  Barr Engineering, Incorporated, contract compliance #31-1347309 (expires November 18, 2006) was selected in April, 1999 in accordance with City Code Chapter 329 for professional service contracts.
 
The original contract amount was $184,480.00.  This modification is for $11,174.00.  The total of all modifications including this one is $90,629.00.  The contract amount including all modifications is $275,109.00.
 
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to maintain the construction schedule and to preserve the public safety and welfare.
 
Fiscal Impact:  The Transportation Division budgeted $981,000 in the 2004 Capital Improvements Budget for City Bridge Rehabilitation.  The Division has expended or encumbered approximately $746,272.00 from the bond sale in July 2004 for bridge rehabilitation.  This ordinance authorizes an expenditure of $11,174.00 for a design modification with Barr Engineering Inc.

Body
 
WHEREAS, contract number EL900258 was authorized by Ordinance 0623-1999, passed by City Council March 15, 1999, executed and approved by the City Attorney on April 5, 1999; and
 
WHEREAS, it is necessary to modify and increase this contract by $11,174.00 per the consultant's letter dated February 11, 2005, for the South High Street over Railroad project; and
 
WHEREAS, as emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay to maintain the construction schedule, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.        That the Public Service Director be and hereby is authorized to modify and increase existing contract number EL900258 with Barr Engineering, Incorporated, to complete the design, construction plans and permits for the South High Street over Railroad project to add 250 feet of sidewalk to the south of the bridge in accordance with the plans on file in the office of the Public Service Director.
 
SECTION 2.  That for the purpose of paying the cost of said contract modification, the sum of $11,174.00 or so much thereof as may be necessary be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530301.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
