Title: To authorize the Director of Public Utilities to re-establish funds needed for the Livingston Avenue 24" Water Main Improvements Project; to authorize an expenditure up to $11,000.00 within the Water Works Enlargement Voted Bonds Fund; for the Division of Power and Water; and to declare an emergency. Explanation
Background:  Ordinance No. 1543-2008 was passed by Columbus City Council on October 20, 2008.  This Ordinance authorized the Public Utilities Director to modify the professional engineering services agreement with EMH&T, Inc. for the Livingston Avenue 24" Water Main Improvements Project.
Purchase Order Number EL008831 was established with EMH&T, Inc.  The purchase order was mistakenly cancelled although services for this project are not complete.
Therefore, the Department of Public Utilities, Division of Power and Water requests that the purchase order (EL-008831) be re-establish funds in the amount of $11,000.00 for expenditures covered by the original ordinance and agreement for this project.

Emergency Designation: It is requested that this Ordinance be handled in an emergency manner in order to expeditiously pay an outstanding invoice.

WHEREAS, Ordinance No. 1543-2008 was passed by Columbus City Council on October 20, 2008 authorizing the Director of Public Utilities to modify the professional engineering services agreement for the Livingston Avenue 24" Water Main Improvements Project; and
 
WHEREAS, the balance of Purchase Order EL008831 for the aforementioned project was mistakenly cancelled; and
 
WHEREAS, re-establishment of funds is needed for the aforementioned project to complete the services within the professional engineering services agreement; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power and Water, in that it is immediately necessary to authorize the Director of Public Utilities to re-establish the a Purchase Order mistakenly cancelled within the Water Works Enlargement Voted Bonds Fund, for the Livingston Avenue 24" Water Main Improvements Project; in an emergency manner in order to expeditiously pay an outstanding invoice, for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That an expenditure up to $11,000.00 is hereby authorized as follows:  Division of Power and Water, Dept./Div. No. 60-09, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Project 690404-100000 (carryover), OCA Code 606404, Object Level One 06, Object Level Three 6686.
 
SECTION 2. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
SECTION 3. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
SECTION 5.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
