Council Variance Application: CV25-034

 

APPLICANT:  SKR V Creative, LLC D.B.A. Crit Apparel; 77 E. Wilson Bridge Road, Suite 100; Worthington, OH 43085.

 

PROPOSED USE:  Screen printing business.

 

WEST SCIOTO AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site consists of one parcel developed with a commercial building in the CPD, Commercial Planned Development District. The requested Council variance will allow a screen printing business, which is considered a manufacturing use, in an existing commercial building. The site is located within the planning boundaries of the Trabue/Roberts Area Plan (2011), which recommends “Mixed Use (Community)” land uses at this location. Additionally, the Plan includes complete adoption of the Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018). Staff supports the request because the screen printing business activities include a retail component which is consistent with the Plan recommendation, and the industrial aspect of the business will not add an incompatible use to the area.

To grant a Variance from the provisions of Section 3361.02, Permitted uses, of the Columbus City Codes; for the property located at 3570 FISHINGER BLVD. (43026), to allow a screen printing business in the CPD, Commercial Planned Development District (Council Variance #CV25-034).

 

Body

 

WHEREAS, by application #CV25-034, the owner of property at 3570 FISHINGER BLVD. (43026), is requesting a Council variance to allow a screen printing business in the CPD, Commercial Planned Development District; and

 

WHEREAS, by Ordinance #0752-90 (Rezoning Application Z90-009A), the CPD, Commercial Planned Development District allows C-1, Commercial through C-5, Commercial district uses; and

 

WHEREAS, Section 3361.02, Permitted uses, prohibits M, Manufacturing District uses, while the applicant proposes to operate a screen printing business, which is considered to be an M, Manufacturing District use, on the subject site; and

 

WHEREAS, the West Scioto Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval of the requested variance because the retail component of the proposed business is consistent with the Trabue/Roberts Area Plan’s land use recommendation, and the industrial aspect of the business will not add an incompatible use to the area; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed use; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 3570 FISHINGER BLVD. (43026) in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Section 3361.02, Permitted uses, of the Columbus City Codes; is hereby granted for the property located at 3570 FISHINGER BLVD. (43026), insofar as said section prohibits a screen printing business in the CPD, Commercial Planned Development District; said property being more particularly described as follows:

 

3570 FISHINGER BLVD. (43026), being 0.77± acres located on the north side of Fishinger Boulevard, 128± feet west of Ridge Mill Drive, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin and in the City of Columbus:

 

Being in Virginia Military Survey No. 547, being a 0.770 acre area of land, more or less, said 0.770 acre area being in Parcel C as the same is designated and delineated upon the recorded plat of Mill Run Subdivision and Street & Easement Dedication Section 2, of record in Plat Book 64, pages 38 and 39, described in the deed to Scott Street Properties, Inc., of record in Official Record 20512C12, both being of record in the Recorder's Office, Franklin County, Ohio, said 0.770 acre area of land being more particularly described as follows:

 

Beginning, for reference, at a P.K. Nail found at the southerly centerline intersection of Fishinger Boulevard (eight feet in width) and Ridge Mill Drive (sixty feet in width), said P.K. Nail being located westerly from, as measured along the centerline of said Fishinger Boulevard, an aluminum cap set in concrete (Franklin County Monument No. FCGS 2239) at the centerline intersection of Smiley Road and said Fishinger Boulevard, the following three (3) courses and distances:

 

1.) S-19°24'30"W, a distance of 54.57 feet to an aluminum cap set in concrete (Franklin County Monument No. FCGS 2241);

2.) S-78°48'43"W, a distance of 120.40 feet to a point of curvature;

3.) with the arc of a curve to the left having a radius of 850.00 feet, a central angle of 17°14'18", a chord distance of 253.44 feet; thence, from said reference point of beginning, southwestwardly, with the centerline of said Fishinger Boulevard and with the arc of a curve to the left having a radius of 850.00 feet, a central angle of 4°41'10" and a chord that bears S-59°19'18"W, a chord distance of 69.50 feet to a P.K. Nail found at a point of tangency; thence, N-33°01'17"W, a distance of 40.00 feet to a 3/4 inch (I.D.) iron pipe found at a point of tangency in the southeasterly boundary of said Parcel C, the same being a point of tangency in the northwesterly right-of-way boundary of said Fishinger Road; thence S 56°58'43"W, with a southeasterly line of said Parcel C and with a northwesterly right-of-way line of said Fishinger Boulevard, a distance of 95.15 feet to a 3/4-inch (I.D.) iron pipe set at the true point of beginning;

 

Thence, from said true point of beginning, S-56°58'43"W, with a southeasterly line of said Parcel C and with a northwesterly right-of-way line of said Fishinger Boulevard, a distance of 104.00 feet to a 3/4-inch (I.D.) iron pipe set;

 

Thence, N-33°01'17"W, a distance of 294.51 feet to a 3/4-inch (I.D.) iron pipe set at a point in a curve;

 

Thence, northeastwardly, with the arc of a curve to the left having a radius of 240.50 feet, a

central angle of 28°12'29" and a chord that bears N-42°27'30"E, a chord distance of 117.21 feet to a 3/4-inch (I.D.) iron pipe set at a point of tangency;

 

Thence, N-28°21'15"E, a distance of 7.44 feet to a 3/4-inch (I.D.) iron pipe set;

 

Thence, S-3°01'17"E, a distance of 57.95 feet to a 3/4-inch (I.D.) iron pipe set;

 

Thence, S-26°54'47"E, a distance of 150.37 feet to a 3/4-inch (I.D.) iron pipe set;

 

Thence, S-33°01'17"E, a distance of 120.00 feet to the true point of beginning, and being a 0.770 acre area of land, more or less.

 

Subject to all rights-of-way, easements, and restrictions, if any, of previous record.

 

We state that the foregoing description: was compiled from deed, plat, and field surveys conducted in February and June of 1995, and January of 1996.

 

All of the survey markers, P.K. nails, and iron pins noted in the foregoing description were in place as of June 1995.

 

The bearings given in the foregoing description are based upon the bearing of N-26°20'07"W as shown along the centerline of Mill Drive on the recorded plat of said Mill Run Subdivision and Street & Easement Dedication Plat Section 2, of record in Plat Book 64, pages 38 and 39, Recorder’s Office, Franklin County, Ohio.
