Explanation
Background: Ordinance No. 0706-2006 passed April 24, 2006 authorizing the City Attorney to acquire certain property rights, and to expend certain monies in connection with the Charleston Avenue Stormwater System Improvements Project. The original amount of funding made available for this project was done so with the understanding that additional monies may be needed at a later date. It is now therefore necessary to establish a separated Auditor's Certificate to expend monies for payment of additional acquisition costs in connection with the Charleston Avenue Stormwater System Improvements Project.
Fiscal Impact: The Department of Public Utilities, Division of Sewerage and Drainage has determined funding for this project will be from the Storm Sewer Bond Fund. The legislation includes a transfer of funds within the Storm Sewer Bond Fund and an amendment to the 2007 Capital Improvements Budget to allow sufficient cash and authority in the proper account for this project.
Emergency Justification: Emergency action is requested to allow the acquisition of the parcels necessary for this project to proceed without delay.

To authorize the City Attorney to acquire fee simple title and lesser interests, and to contract for professional services; to authorize the transfer of $30,500.00 within the Storm Sewer Bond Fund; to authorize the amendment of the 2007 Capital Improvements budget; and to authorize the expenditure of $30,500.00 from the Storm Sewer Bond Fund; for costs in connection with the Charleston Avenue Stormwater System Improvements Project, and to declare an emergency. ($30,500.00).

WHEREAS, Ordinance No. 0706-2006 passed April 24, 2006 authorizing the City Attorney to acquire certain property rights, and to expend certain monies in connection with the Charleston Avenue Stormwater System Improvements Project; and
WHEREAS, the original amount of funding made available for this project was done so with the understanding that additional monies may be needed at a later date; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Storm Sewer Bond Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient budget authority for the project expenditure; and
WHEREAS, it is necessary for the City Council to authorize the expenditure of funds from the Storm Sewer Bond Fund; and
WHEREAS, an emergency exists in that it is immediately necessary to establish a separated Auditor's Certificate to expend the aforementioned monies for payment of additional acquisition costs in connection with the Charleston Avenue Stormwater System Improvements Project, to pay additional costs and other fees necessary to the acquisition of real estate for the above referenced project for the preservation of the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate in connection with the Charleston Avenue Stormwater System Improvements Project, Project # 610742.
Section 2. That the City Auditor be and hereby is authorized and directed to transfer a total of $30,500.00 from within the Storm Sewer Bond Fund No. 685 | Divison 60-15 | Object Level Three No. 6601:

Section 3. That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the project expediture stated in the ordinance herein.

Section 4. That the expenditure of $30,500.00, or so much thereof as may be necessary for the Charleston Avenue Stormwater System Improvements Project, Project # 610742, from the Storm Sewer Bond Fund, Fund #685, OCA Code 685742, Object Level Three 6601, Division 60-15, for the appropriation of said real property interests determined to be necessary for the stated public purpose is hereby authorized.
Section 5. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 6. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
Section 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
