CITY DEPARTMENTS' RECOMMENDATION: Approval. The 14.00± site consists of five undeveloped parcels in the R, Rural District. The requested L-AR-1, Limited Apartment Residential District will allow a multi-unit residential development with a maximum of 264 dwelling units developed in accordance with the submitted site plan. Although the proposed use is inconsistent with the Northeast Area Plan’s (2007) recommendation of “Office-Light Industrial” land uses at this location, the Plan recommends a mix of housing price points within all neighborhoods to provide housing opportunities throughout the Northeast Area, ensuring the availability of housing near jobs. As such, staff recognize the proposal’s location on a corridor with transit, and compatibility with existing apartment residential to the west, as mitigating factors for support of the use. A concurrent Council variance (Ordinance #2517-2025; CV25-043) is also being considered to reduce development standards for building and parking setback lines and detached garage height.

WHEREAS, application #Z25-024 is on file with the Department of Building and Zoning Services requesting rezoning of 14.00± acres from R, Rural District, to the L-AR-1, Limited Apartment Residential District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the Northeast Area Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval of the zoning change because the requested L-AR-1, Limited Apartment Residential District will allow multi-unit residential development at a density consistent with the area’s emerging residential development pattern and transit connectivity. The proposal also aligns with the City’s objective of providing additional housing; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

I. INTRODUCTION: The subject property consists of 14+/- acres (the “Site”) located at the east side of Stelzer Road. The property is currently being annexed to the City of Columbus. The site is surrounded by properties in Mifflin Township to the north, east and south and CPD to the west.
The applicant proposes to rezone the Site to L-AR-1 to allow for the construction of a multi-family apartment community.
So long as the site is developed as a multi-family apartment community, the site will be developed in accordance with the Site Plan attached as Appendix 1 (the “Site Plan”).
II. PERMITTED USES: Uses in Sections 3333.02, AR-12, ARLD and AR-1 apartment residential district uses of the City of Columbus Code.
III. DEVELOPMENT STANDARDS: Unless otherwise indicated in this text or drawings, the applicable development standards are contained in Chapter 3333 of the Columbus City Code.
A. Density, Height, Lot and/or Setback Commitments
1. The maximum number of dwelling units shall be 264.
2. The height of the garages is increased from 15 to 16 feet (see CV25-043).
3. The front setback along Stelzer Road is decreased from 60 feet to 25 feet (see CV25-043) as shown on the Site Plan.
4. The parking setback along the southeastern property line adjacent to I-670 is decreased from 25 feet to 5 feet (see CV25-043) as shown on the Site Plan.
5. The building setback along the southeastern property line adjacent to I-670 is decreased from 25 feet to 5 feet (see CV25-043) as shown on the Site Plan.
B. Access, Loading, Parking, and/or Other Traffic Related Commitments

C. Buffering, Landscaping, Open Space and/or Screening Commitments
The site will be landscaped in accordance with the submitted Site Plan. Notwithstanding the foregoing, utilities may be located within the twenty-five (25) foot perimeter yard setback along the western property line west of Buildings 9, 10 and 11 as shown on the Site Plan as may be required by the City of Columbus.
D. Building Design and/or Interior-Exterior Treatment Commitments
The buildings will be constructed in accordance with the submitted building elevations. The building elevations may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development plan and when engineering and architectural drawings are completed. Any slight adjustments to the building elevations shall be subject to review and approval by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding proposed adjustment.
E. Lighting, Outdoor Display Areas, and/or other Environmental Commitments

F. Graphics and Signage Commitments
All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the AR-1 zoning classification and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
G. Miscellaneous
1. The developer shall comply with the park land dedication ordinance by contributing money to the City’s Recreation and Parks Department.
2. The Site shall be developed in accordance with the Site Plan; however, the Site Plan may be slightly adjusted to reflect engineering, topographical or other site data developed at the time that development and engineering plans are completed. Any slight adjustment to the plans shall be reviewed and may be approved by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
