Explanation

This legislation authorizes the Director of the Department of Development to modify a contract with Evolved Plumbing and Mechanical, LLC, in an amount up to $50,000.00 to provide residential emergency heating, plumbing, and water and sewer services as part of the Division of Housing’s Emergency Repair Program.  This legislation will extend the existing contract through February 28, 2026.

Emergency Heating, Plumbing, and Water and Sewer Repair is part of the Emergency Repair Program, operated by the Division of Housing.  The program was established to assist low and moderate-income homeowners with heating, plumbing, and water and sewer issues that constitute an emergency condition.  Emergency repairs under this legislation will address small and large-scale capital home improvements that, if not corrected, may require the owner to vacate their home.  Most homeowners are at or below 50% AMI as defined by HUD with exceptions allowed up to 80% AMI.

 

The department advertised RFQ026104 on Vendor Services seeking contractors to provide emergency mechanical repairs on October 10, 2023 with bids being due on November 3, 2023.  The Emergency Repair Program is a home repair program operated by the Housing Division. 

 

In accordance with C.C. 329.09(a):

1.                     The amount of additional funds planned to be expended under this modification is $50,000.00.

2.                     The need for additional services was unforeseen at the time the initial contract was awarded, but a legislative modification is required by operation of C.C. 329.09(b).

3.                     It is in the City’s best interest to continue with the Evolved Plumbing and Mechanical, LLC current contract to provide residential emergency heating, plumbing, and water and sewer services as part of the Division of Housing’s Emergency Repair Program, as to not interrupt current services. 

4.                     The pricing provided and accepted with the bid received for RFQ026104 will be maintained with this modification. 

 

Emergency action is requested to continue performing needed repairs for residents as quickly as possible.

 

FISCAL IMPACT:  Funding is available within the within the Department of Development, Housing Division 2025 General Fund budget, this ordinance is contingent on the passage of the 2025 Operating Budget, Ordinance 3035-2024.

 

CONTRACT COMPLIANCE:  vendor number 030026 and expires 08/30/2026.

 

 

Title

To authorize the Director of the Department of Development to modify an existing contract by adding additional funding in an amount up to $50,000.00 with Evolved Plumbing and Mechanical, LLC, to provide residential emergency heating, plumbing, and water and sewer services as part of the Division of Housing’s Emergency Repair program; to extend the contract term for one additional year through February 28, 2026; to authorize the expenditure of up to $50,000.00 from the 2025 General Fund; and to declare an emergency. Body

WHEREAS, the Emergency Repair Program was established to assist low and moderate income homeowners with emergency heating, plumbing, and water and sewer services that would impact a household remaining safely in their home; and

 

WHEREAS, the Department of Development has advertised on RFQ026104 for the Emergency Repair Program requesting pricing from contractors to provide emergency mechanical services; and

 

WHEREAS, a contract was authorized with Evolved Plumbing and Mechanical, LLC for $200,000.00 under Ord. 0200-2024; and

 

WHEREAS, modification No. 1 was approved to add additional funding, $200,000.00, with Ord. 2151-2024; and 

 

WHEREAS, this legislation authorizes the Director of the Department of Development to modify a contract with Evolved Plumbing and Mechanical, LLC to authorize expenditures in an amount up to $50,000.00 to provide residential emergency heating, plumbing, and water and sewer services; and

 

WHEREAS, this legislation also authorizes the extension of the existing contract through February 28, 2026; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to authorize the Director to modify an existing contract with Evolved Plumbing and Mechanical, LLC to add additional funding and to extend the contract term for one year as there exists no current heating, plumbing, and water and sewer contractor to provide services under the Emergency Repair Program, without which, residents of these households, who cannot afford the expense of services, may not be able to remain in their homes, all for the immediate preservation of the public health, peace, property, safety, and welfare; and NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Development be and is hereby authorized to modify a contract, in an amount up to $50,000.00, with Evolved Plumbing and Mechanical, LLC and extend the contract for one additional year through February 28, 2026.

 

SECTION 2.  That for the purpose as stated in Section 1, the expenditure of $50,000.00, or so much thereof as may be necessary, is hereby authorized in fund 1000 (General Fund), Dept-Div 44-10 (Housing), object class 03 (Services) per the account codes in the attachment to this ordinance.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That this modification is made in accordance with the relevant provisions of the City Code Charter 329 relating to contract modifications.

 

SECTION 6. That for the reasons stated in the Preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
