Council Variance Application: CV23-077

 

APPLICANT: Joshua Tomey; 1282 East Fulton Street; Columbus, OH 43205.

 

PROPOSED USE: Two single-unit dwellings on one lot.

 

COLUMBUS SOUTH SIDE AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of two single-unit dwellings in the R-2F, Residential District. The requested Council variance will allow the applicant to remove and replace an existing home addition and to conform the existing dwellings. A Council variance is required because the R-2F district only allows one single-unit dwelling per lot. The request includes variances to driveway width, parking setback, number of parking spaces, lot width, area district requirements, lot coverage, maximum and minimum side yards, and rear yard requirements. The site is located with the planning boundaries of the Southside Plan (2014), which recommends “Medium-High Density Residential” land uses at this location, which is generally consistent with the proposal.

To grant a Variance from the provisions of Sections 3332.037, R-2F residential district; 3312.13, Driveway; 3312.27, Parking setback line; 3312.49, Minimum numbers of parking spaces required; 3332.05(A)(4), Area district lot width requirements; 3332.14, R-2F area district requirements; 3332.18(D), Basis of computing area; 3332.25, Maximum side yards required; 3332.26, Minimum side yard permitted; and 3332.27, Rear yard, of the Columbus City Codes; for the property located at 473 E. BECK ST. (43206), to allow two single-unit dwellings on one lot with reduced development standards in the R-2F, Residential District (Council Variance #CV23-077).

 

Body

 

WHEREAS, by application #CV23-077, the owner of the property at 473 E. BECK ST. (43206), is requesting a Variance to allow two single-unit dwellings on one lot with reduced development standards in the R-2F, Residential District; and

 

WHEREAS, Section 3332.037, R-2F, Residential District Use, allows one single-unit or two-unit dwelling on a lot, while the applicant proposes to maintain two single-unit dwellings on one lot; and

 

WHEREAS, Section 3312.13, Driveway, requires a minimum driveway width of 10 feet, while the applicant proposes to maintain the existing driveway that is 8.58 feet wide; and

 

WHEREAS, Section 3312.27, Parking setback line, requires a minimum parking setback line of 10 feet, while the applicant proposes a zero foot parking setback along East Beck Street; and

 

WHEREAS, Section 3312.49, Minimum number of parking spaces required, requires two parking spaces per dwelling unit for a total of four parking spaces for two dwelling units, while the applicant proposes two parking spaces; and

 

WHEREAS, Section 3332.05(A)(4), Area district lot width requirements, requires a minimum lot width of 50 feet in the R-2F, Residential District, while the applicant proposes to maintain a reduced lot width of 32± feet; and

 

WHEREAS, Section 3332.14, R-2F area district requirements, requires a 6,000 square foot lot for a single-unit dwelling, while the applicant proposes two single-unit dwellings on one lot containing 3,072 square feet, pursuant to the lot area calculation in Section 3332.18(C); and

 

WHEREAS, Section 3332.18(D), Basis of computing area, prohibits buildings from occupying more than 50 percent of the lot area, while the applicant proposes an increased lot coverage of 52 percent; and

 

WHEREAS, 3332.25, Maximum side yards required, requires that the sum of the widths of the side yards equal or exceed 20 percent of the width of the lot, or 6.4 feet for a lot width of 32 feet, while the applicant proposes a reduced maximum side yard of 5.42 feet for the front dwelling and 5.66 feet for the rear dwelling; and

 

WHEREAS, 3332.26, Minimum side yard permitted, requires that the minimum side yard be no less than three feet, while the applicant proposes a side yard of 2.42 feet on the west side of the front dwelling and a side yard of 1.42 feet on the east side of the rear dwelling and

 

WHEREAS, 3332.27, Rear yard, requires that each dwelling, residence, or principal building shall be erected so as to provide a rear yard totaling no less than 25 percent of the total lot area, while the applicant proposes reduced rear yard of 14 percent for the front dwelling and no rear yard for the rear dwelling; and

 

WHEREAS, the Columbus South Side Area Commission recommends approval; and

 

WHEREAS, City Departments recommend approval because the proposed use is generally consistent with the “Medium-High Density Residential” land uses recommendation of the Southside Plan at this location, and will not introduce an incompatible use to the area; and 

 

WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for the proposed addition; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 473 E. BECK ST. (43206), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Sections 3332.037, R-2F residential district; 3312.13, Driveway; 3312.27, Parking setback line; 3312.49, Minimum numbers of parking spaces required; 3332.05(A)(4), Area district lot width requirements; 3332.14, R-2F area district requirements; 3332.18(D), Basis of computing area; 3332.25, Maximum side yards required; 3332.26, Minimum side yard permitted; and 3332.27, Rear yard; of the Columbus City Codes; for the property located at 473 E. BECK ST. (43206), insofar as said sections prohibit two single-unit dwellings on one lot in the R-2F, Residential District; with a reduced driveway width from 10 feet to 8.58 feet; reduced parking setback line from 10 feet to zero feet; a parking space reduction from four spaces to two spaces; reduced minimum lot width from 50 feet to 32± feet; reduced lot area from 6,000 square feet per dwelling to 3,072 square feet for both dwellings; increased lot coverage from 50 percent to 52 percent; reduced maximum side yard from 6.4 feet to 5.42 feet for the front dwelling and 5.66 feet for the rear dwelling; reduced minimum side yard from three feet to 2.42 feet on the west side of the front dwelling and to 1.42 on the east side of the rear dwelling; and reduced rear yard from 25 percent to 14 percent for the front dwelling and no rear yard for the rear dwelling; said property being more particularly described as follows:

 

473 E. BECK ST. (43206), being 0.10± acres located on the south side of East Beck Street, 165± feet east of East Cherry Street:

 

Situated in the State of Ohio, County of Franklin, City of Columbus Being Lot 34 Dunham, Rankin, and Stewart Subdivision, Plat Book 4, Page 79

 

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for two single-unit dwellings on one lot, in accordance with the submitted site plan, or those uses permitted in the R-2F, Residential District.

 

SECTION 3. That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan titled, "SINGLE FAMILY RENOVATION & ADDITION”, dated October 20, 2023, and signed by Joshua Tomey, Applicant. The plans may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed.  Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed addition.

 

SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
