Explanation
 
Background:  Since July 2005, the City has leased 4,014 square feet of office space at 655 E. Livingston Avenue, Columbus, Ohio 43205 from the Center for Child and Family Advocacy at Nationwide Children's Hospital pursuant to the terms of a Memorandum of Understanding and an Operating Agreement for use by the Division of Police Special Victims Bureau.  The City of Columbus entered into the current Amendment #1 to Operating Agreement with the Center for Child and Family Advocacy at Nationwide Children's Hospital, which was authorized by Ordinance #0909-2009 and passed by Columbus City Council on 07/08/2009, for an initial term of one (1) year and three (3) automatic one (1) year renewal terms subject to the appropriation of funding by Columbus City Council and the certification of funds availability by the City Auditor.  The funds for the second of the three (3) automatic one (1) year renewal terms, in the amount of $33,667.00, were appropriated by Ordinance #0173-2011, passed March 2, 2011.
 
This legislation authorizes the Director of Finance and Management to expend $33,667.00  for the period January 1, 2011 to December 31, 2011, the second of the three (3) automatic one (1) year renewal terms, for reimbursement of operating expenses associated with the lease of office space.
 
The Center for Child and Family Advocacy at Nationwide Children's Hospital Contract Compliance Number is 02-0627166001, with an expiration date of 09/03/2011.
 
Fiscal Impact:  This ordinance authorizes the expenditure of $33,667.00 from the Special Income Tax Fund appropriated pursuant to Ordinance #0173-2011, passed March 2, 2011.
 
Emergency action is requested to provide payment for the reimbursement of operating expenses to the Center for Child and Family Advocacy at Nationwide Children's Hospital in a timely manner for the 2011 term of the amended Operating Agreement.

WHEREAS, the City leases 4,014 square feet of office space at 655 E. Livingston Avenue, Columbus, Ohio 43205 from the Center for Child and Family Advocacy at Nationwide Children's Hospital; and
 
WHEREAS, the City appropriated funds from the Special Income Tax for reimbursement of operating expenses pursuant to Ordinance #0173-2011; and
 
WHEREAS, it is necessary to authorize the expenditure of funds for the reimbursement of operating expenses; and
 
WHEREAS, an emergency exists in the usual daily operations of the Finance and Management Department, Real Estate Management Office, in that it is immediately necessary to authorize the Finance and Management Director to expend funds to allow for timely reimbursement of operating expenses for the second of three (3) automatic one (1) year renewals of the amended Operating Agreement with the Center for Child and Family Advocacy at Nationwide Children's Hospital as previously authorized by Council ensuring that City operations continue uninterrupted, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1. That the Director of Finance and Management be, and hereby is, authorized to expend $33,667.00 for payment of reimbursement of operating expenses for the second of three (3) automatic one (1) year renewal term for the period January 1, 2011 to December 31, 2011 for Amendment #1 to Operating Agreement with the Center for Child and Family Advocacy at Nationwide Children's Hospital at 655 E. Livingston Avenue, Columbus, Ohio 43205.
 
SECTION 2. That the expenditure of $33,667.00 from the Special Income Tax Fund, be and is hereby authorized and approved as follows:

SECTION  3. That the City Auditor is authorized to make any accounting changes necessary to ensure that this contract is properly accounted for and recorded accurately on the City's financial records.  That the City Auditor is authorized to make any changes to revise the funding source for any contract or contract modifications associated with this ordinance.
 
SECTION  4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
