Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to execute a professional engineering services contract modification with Malcolm-Pirnie, Inc., in connection with the contract for wastewater treatment and collection system regulatory compliance services for the Division of Sewerage and Drainage. These services are required to provide the engineering and technical expertise which is necessary to assist the Division in its efforts to adequately address state and federal regulatory matters.
2. PROFESSIONAL ENGINEERING SERVICES MODIFICATION INFORMATION: The Division of Sewerage and Drainage has determined that these services cannot be performed by city personnel at this time, and established this contract for purposes of funding regulatory and technical service consultation services incrementally by modification. This modification is the final, planned modification for these services under the terms of the original procurement effort performed in 2000. The contract total including this modification is $1,047,500.00.
3. FISCAL IMPACT:
The Division has included funding for this contract modification within its 2004 Sanitary Operating Budget.

($262,500.00)

WHEREAS, Contract No. EL000445, was authorized by Ordinance No. 1000-00, as passed by Columbus City Council on April 24, 2000, for purposes of authorizing the Director of Public Utilities to execute a professional engineering services agreement for Wastewater Treatment and Collection System Regulatory Compliance and General Technical Services with Malcolm Pirnie, Inc.; and
WHEREAS, Modification No. 1, identified as Contract No. EL002601, was authorized by Ordinance No. 1089-2002, as passed by Columbus City Council on July 15, 2002, for purposes of providing the incremental funding for services under the subject contract for current fiscal year needs; and
WHEREAS, this contract was established with the intent to provides services during for a four year duration, and as such it is necessary to request a contract modification for purposes of increasing the contract amount to provide for the payment of services anticipated during the remainder of 2004; and
WHEREAS, it is necessary for this Council to authorize the Director of Public Utilities to enter into a modification with Malcolm-Pirnie, Inc., in connection with the aforementioned services that assist the Division of Sewerage and Drainage in complying with the applicable environmental regulatory requirements, at the earliest practicable date; now, therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities is hereby authorized to execute a modification agreement with Malcolm-Pirnie, Inc., 1900 Polaris Parkway, Suite 200, Columbus, Ohio 43240-2020 for professional services associated with the Wastewater Treatment and Collection System Regulatory Compliance and General Technical Services.
Section 2. That the Director of Public Utilities be and hereby is, authorized to modify the existing professional engineering service agreement no. EL000445 with Malcolm Pirnie; and to pay up to a maximum amount of $262,500.00 for the estimated additional services required during the 2004 Fiscal Year, in accordance with the terms and conditions as shown in the contract modification agreement on file in the General Engineering Section of the Division of Sewerage and Drainage.
Section 3. That the expenditure of $262,500.00, or as much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund No. 650| Division 60-05| OCA Code 605584| Object Level Three 3336.
Section 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
