WHEREAS, application #Z03-117 is on file with the Building Services Division of the Department of Development requesting rezoning of 4.98± acres from CPD, Commercial Planned Development District, to CPD, Commercial Planned Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested CPD, Commercial Planned Development District carries forward development standards consistent with established zoning and development patterns of the area while adding the use of vinyl siding as a building material, now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Purpose: Mr. Robert L. Huff, Scioto Retirement Community and Villas of Scioto, Inc. purpose is to develop an overall retirement community design under the City of Columbus commercial planned development (CPD) text guidelines. In addition, the Villas of Scioto, Inc. and Scioto Retirement Community incorporate this parcel into the overall master plan of the community. Under this CPDS, the Villas of Scioto, Inc. and Scioto Retirement Community will be adding senior housing for the elderly to serve this population within the City of Columbus and Franklin County.
 
I. Description: The subject site is 4.982± acre parcel which is located adjacent to the Scioto Retirement Community. The site is bordered on the north by the nursing home and assisted living facility. In addition, the subject site is bordered on the west by land presently owned by Mr. Huff and proposed for the development of additional independent cottage units and on the east by residential homes.
II. Allowable Uses: Under the City of Columbus CPD code, the allowable use consists of senior housing for the elderly.
 
III. Applicable Development Standards: Except as otherwise specified, the site shall be developed in accordance with the submitted site plan/elevations and this written text and the development standards contained in Chapter 3361, CPD. Minor adjustments to the submitted site plan due to site engineering or other issues may be permitted subject to the review and approval by the Director of Building Services Division or his designee.
A. Density, Height, Lot and/or Setback Commitments.
 
1) The minimum building setback from the street property line is twenty-five (25) feet.
 
B. Access, Loading, Parking and/or Other Traffic Related Commitments.
 
1) Access will be available from Parsons Road (east) and Obetz Road (north). The access design and location will be reviewed and approved by the City of Columbus, Division of Transportation.
2) Any loading space(s) will be provided at the rear of the principal building.
C. Buffering, Landscaping, Open Space and/or Screening Commitments.
1) Landscaping shall be installed and properly maintained around the individual units and as shown on the site plan.
D. Building Design and Exterior Treatment Commitments.
1) The building exteriors shall be of brick and vinyl siding.
E. Lighting Outdoor Display Areas.
 
1) Lighting: All exterior lighting shall be cut-off (down-lighting). Cut-off fixtures are those which have an interior reflector system for lighting distribution that cuts off the direct shining light at an angle below the horizon. All exterior lighting fixtures shall be the same or similar manufacturer's type to insure aesthetic compatibility. Any accent lighting shall be directed toward the building signage, or landscaping and shall not interfere with neighborhood uses or right-of-way traffic.
2) Lighting shall be no higher than fourteen (14) feet.
F. Graphics and/or Signage Commitments.
1) All signage and graphics shall conform to article 15 of the City of Columbus Graphic Code as it applies to the zoning district. Any variance of the sign requirements will be submitted to the City of Columbus Graphics Commission.
Commercial Planned Development Text Requirements
 
A. Natural Environment - The project will maintain the natural character of the area by planting trees, constructing a pond, and creating walking trails throughout the overall development.
B. Existing Land Use: The property is currently zoned CPD.
C. Transportation and Circulations: A pedestrian walking trail and sidewalk will be constructed and maintained by the Owner. All drives and roadways will be reviewed and approved by the City of Columbus, Division of Transportation.
D. Visual Form of the Environment: The project shall be residential in appearance and compatible with the surrounding area.
E. View and Visibility: The applicant believes the proposed project use and improvements will enhance the area. The applicant believes that the proposed use will in no way diminish the surrounding neighborhood.
F. Proposed Development: The development will be a health related or elderly housing project.
G. Behavior Patterns: The proposed use will serve the elderly population and/or elderly housing project.
H. Emissions: Emissions generated from the use of this site will not effect the environment or alter the use and enjoyment of the surrounding neighborhood.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
