Explanation
BACKGROUND:
This ordinance authorizes the Finance and Management Director to establish purchase orders to purchase an Electronic Fuel Tank Monitoring system, including equipment and subscription to software/cloud-based platform for 110 existing fuel storage tanks on behalf of Fleet Management Division. The purchase order will be issued from a Universal Term Contract previously established by the City of Columbus, Purchasing Office. The Department of Finance and Management Fleet Management Division solicited a formal best value proposal (BVP) solicitation for the purchase of an Electronic Fuel Tank Monitoring system, in accordance with the relevant provisions of Chapter 329 of City Code. RFQ028229 closed on 8/15/2024.

EMERGENCY: Emergency legislation is requested to authorize the contract and the expenditure to permit evaluations to continue without interruption.
FISCAL IMPACT: Funds are available within the 2024 Fleet Operating fund for this purpose.

To authorize and direct the Director of Finance and Management on behalf of the Fleet Management Division to allow the purchase of an Electronic Fuel Tank Monitoring system, including equipment and subscription to software/cloud-based platform for 110 existing fuel storage tanks; to authorize the expenditure of $74,742.96 for the purchase of an Electronic Fuel Tank Monitoring system, including equipment and subscription to software/cloud-based platform for 110 existing fuel storage tanks from the Fleet Management Operating Fund; and to declare an emergency. ($74,742.96)

WHEREAS, it is necessary to authorize the Director of Finance and Management to allot and expend $74,742.96 for the purchase of an Electronic Fuel Tank Monitoring system, including equipment and subscription to software/cloud-based platform for 110 existing fuel storage tanks with Benchmark Biodiesel Inc; and
WHEREAS, Benchmark Biodiesel, Inc. successfully bid and was awarded contract PA006764 - Diesel, Biodiesel and Non-Road Diesel UTC, expires 9/30/2025; and
WHEREAS, RFQ028229 was posted on vendor services and closed 8/15/2024; and
WHEREAS, funding for this purchase is budgeted and available within the Fleet Management Operating Fund; and
WHEREAS, an emergency in the usual daily operation of the Fleet Management Division exists to authorize the Director of Finance and Management to expend $74,742.96 with Benchmark Biodiesel to purchase of an Electronic Fuel Tank Monitoring system, including equipment and subscription to software/cloud-based platform for 110 existing fuel storage tanks for the City of Columbus, all for the immediate preservation of the public health, peace, property, safety, and welfare; and Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to issue purchase orders for the Fleet Management Division, per the terms and conditions of established Universal Term Contracts for City Vehicle Diesel, Biodiesel and Non-Road Diesel, as follows:

SECTION 2. That the expenditure of $74,742.96, or so much thereof as may be necessary, is authorized from Fund 5200 (Fleet Operating), Department-Division 4505 (Fleet Management), in Object Class 02 (Materials and Supplies), per the accounting codes in the attachment to this ordinance.

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 4. That the funds necessary to carry out the purpose of this ordinance are deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5. That for the reasons in the preamble hereto, which is made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after passage if the Mayor neither approves nor vetoes the same.
