Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to modify the professional engineering services agreement with E. P. Ferris & Associates, Inc. for additional services that are required to prepare construction plans and specifications for stormwater and sanitary sewer improvements that are to be incorporated into a storm sewer improvement project that was authorized under the original contract.  The additional services will cost $45,055.00 with $19,541.00 for the sanitary sewer component and $25,514.00 for the stormwater component.
 
2. PROFESSIONAL ENGINEERING SERVICES MODIFICATION AWARD:
The original contract purpose was to develop plans for stormwater improvements for Petzinger Road.  During the preparation of the plans it was determined that sanitary sewer improvements should also be incorporated into the construction contract in order to upgrade service, for cost effectiveness, and to reduce the impact of construction upon the neighborhood.  The contract total including this modification is $103,978.58.  The potential need for the additional work could not be foreseen until preliminary field work and design services could be performed.  It is not deemed either feasible or reasonable to suspend work with the entity currently under contract and undertake the continuation of these services with another procurement.  The cost of the modification is a continuation of the vendor's current pricing structure, as verified by City staff.
 
3.  FISCAL IMPACT:
The Sanitary portion of the project will be funded with unencumbered funds within the 1991 Voted Sanitary Bond Fund.  The Stormwater portion of this project will be funded with funds from the Storm Sewer Bond Fund.  Incorporating the design and construction of these sanitary improvements with the stormwater improvements will save time and money for the City of Columbus.
 
4.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting this ordinance to be made an emergency measure in order to allow for the immediate commencement of the necessary stormwater and sanitary sewer infrastructure design improvements that are to be incorporated into the existing Petzinger Road Storm Sewer Improvements Project.

Body
WHEREAS, Contract No. EL003339 was authorized by Ordinance No. 0229-03 as passed by Columbus City Council on March 3, 2009, executed April 14, 2003, and approved by the City Attorney on April 17, 2004, for purposes of preparing construction plans and specifications in connection with the Petzinger Road Stormwater System Improvements Project, for the Division of Sewerage and Drainage, Department of Public Utilities; and
 
WHEREAS, during the development of the plans, the Stormwater Section proposed incorporating the design and construction of sanitary sewer improvements into the scope of the project; thereby allowing the City to cooperatively make all the necessary improvements within one construction contract, and
 
WHEREAS, it is necessary to modify this contract to authorize the funds required to allow payment for additional engineering services associated with this project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities in that it is immediately necessary for the Director of Public Utilities to be granted the authority to amend an existing contract with E.P. Ferris & Associates, Inc., pursuant to the development and incorporation of sanitary sewer improvements in connection with the stormwater improvements project known as the Petzinger Road Stormwater System Improvements Project; for the preservation of the public health, peace and safety; now, therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the City Auditor is hereby authorized to transfer $25,514.00 within the Storm Sewer Bond Fund, Fund No. 685; Division of Sewerage and Drainage, Division 60-15, as follows:

Section 2.  That the City Auditor is hereby authorized to transfer monies within the said fund, in connection, with the Petzinger Road Sanitary Sewer Improvements Project as follows:

Section 3.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project, except that no transfer shall be made from a project account funded by monies from more than one source.
 
Section 4.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 5.  That the Director of Public Utilities be, and hereby is authorized to modify Contract No. EL003339 with E. P. Ferris & Associates, Inc., 880 King Avenue, Columbus, Ohio 43212, for purposes of providing professional engineering services that are required to develop construction plans and specification for stormwater and sanitary sewer improvements that will be incorporated with the existing Petzinger Road Stormwater Improvements Project, in accordance with the terms and conditions as shown in the contract modification agreement on file in the office of the Division of Sewerage and Drainage.
 
Section 6. That for the purpose of paying the cost of the professional engineering services contract modification the expenditure of $25,514.00, or as much thereof as may be needed, is hereby authorized from the Storm Sewer Bond Fund No. 685| Division 60-15| Project 610739| OCA Code 685739| Object Level 6682.
 
Section 7.  That for the purpose of paying the cost of the professional engineering services contract modification the expenditure of $19,541.00, or as much thereof as may be needed, is hereby authorized from the 1991 Voted Sanitary Bond Fund No. 664| Division 60-05| Project 650739| OCA Code 664739| Object Level 6676.
 
Section 8.  That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, in order to provide sufficient budget authority for the execution of the subject construction professional engineering services contract modification:
