Explanation

1.  Background

The Maronda Homes, LLC of Ohio by Todd Lipschutz, Division President, owner of the platted land, has submitted the plat titled “Spangler Farms” to the City Engineer’s Office for review and approval.  This plat has been reviewed and approved by the City Engineer.  The following ordinance allows the City to accept said plat for property located for a subdivision of lots numbered 1 to 109, both inclusive and reserves “A,” “B1,” and “B2.”

 

2.  Fiscal Impact

There is no fiscal impact to the City to accept the plat.

 

3.  Emergency Justification

Emergency action is requested, due to the short construction season in Ohio. This will allow the plat to be recorded as soon as possible, so the County can issue parcel numbers, allowing the development to proceed, certified addresses to be issued, construction of proposed roads, and homes/buildings to be built. Additionally, it will allow the inspection and Construction Agreement to be finalized with the City as soon as possible.

Body

WHEREAS, the plat titled “Spangler Farms” (hereinafter “plat”) has been submitted to the City Engineer’s Office for approval and acceptance; and

 

WHEREAS, Maronda Homes, LLC of Ohio by Todd Lipschutz, Division President, owner of the platted land, desires to dedicate to the public use all or such parts of the avenues and easements shown on said plat and not heretofore so dedicated; and

 

WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that said plat should be accepted immediately to allow new development in the area of Spangler Farms to proceed as quickly as possible, to ensure the safety of the traveling public, for the immediate preservation of the public health, peace, property, and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the plat titled “Spangler Farms” on file in the office of the City Engineer, Division of Design and Construction, be and the same is hereby accepted.

 

SECTION 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
