REZONING APPLICATION:  Z08-021
 
APPLICANT: Central Point Shopping Center Limited; c/o Eric Leibowitz; 191 West Nationwide Boulevard, Suite 200;  Columbus, Ohio 43215.
      
PROPOSED USE:  Commercial development.
 
SOUTHWEST AREA COMMISSION RECOMMENDATION:  Approval.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on August 14, 2008.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The 6.6± acre site is developed with a shopping center zoned in the M-2 Manufacturing District.  The shopping center also extends onto adjacent property zoned in the C-4, Commercial, and M, Manufacturing Districts.   The applicant is requesting the C-4, Commercial District to conform the shopping center.  Retail uses are permitted in the C-4 and M districts, but not in the M-2 district.  The rezoning will replace the M-2, Manufacturing District, which is currently adjacent to the single-family residential uses to the south.  The request will not introduce a new use and is compatible with development in the area.

WHEREAS, application #Z08-021 is on file with the Building Services Division of the Department of Development requesting rezoning of 6.6± acres from M-2, Manufacturing District, to C-4, Commercial District; and
 
WHEREAS, the Southwest Area Commission recommends approval of said zoning change; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the request will not introduce a new use and is compatible with development in the area, now therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
619-699 HARRISBURG PIKE (43223), being 6.6± acres located west of the intersection of Harrisburg Pike and Brown Road, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, being part of Virginia Military Survey No. 422 and being part of that 13.672 acre Parcel I described in a deed to Central Point Shopping Center Limited of record in Instrument 199804090085078 (all references in this description are to the records in the Recorder's Office, Franklin County, Ohio) and being more particularly described as follows:
 
      Beginning, for reference, at a monument box found at the centerline intersection of Harrisburg Pike (U.S. Route 62) with the centerline of Central Avenue, being shown as Harrisburg Pike Station 10+15.49 on the "Centerline Survey Plat" for Fra. Mound St. at Central Avenue of record in Plat Book 44, Page 8;
 
      Thence South 29° 50' 00" West 255.22 feet, along the centerline of Harrisburg Pike, to a point;
 
      Thence North 60° 10' 00" West 30.00 feet, to a 5/8" rebar set at the northeasterly corner of said 13.672 acre tract;
 
      Thence South 29° 50' 00" West 153.57 feet, along the westerly right-of-way line of Harrisburg Pike, to a point;
 
      Thence South 70° 12' 03" West 334.28 feet, to THE TRUE POINT OF BEGINNING;;
 
      Thence South 29° 50' 00" West 685.88 feet, to a point on the northerly line of Thomas E. Humphrey's Subdivision of record in Plat Book 10, Page 182;
 
      Thence South 81° 30' 49" West 733.56 feet, along the northerly line of said subdivision, to the northwesterly corner of said subdivision;
 
      Thence North 45° 16' 39" East 712.70 feet, along the easterly line of a 60 foot wide railroad right-of-way line of CSX TRANSPORTATION, INC., to a point;
 
      Thence North 70° 12' 03' East 595.55 feet, to the True Point of Beginning, containing 6.584 acres of land, more or less.
      
      NOTE:  Bearings are used for the determination of angles only.  For the purpose of this description, a bearing of North 29° 50' 00" East was used on the centerline of Harrisburg Pike as shown on the centerline survey plat for "FRA.MOUND ST. AT CENTRAL AVE." in Plat book 44, Page 8, Recorder's Office, Franklin County, Ohio.  The 5/8" rebars set are 30" long with yellow plastic caps stamped "SITE ENG INC."
 
To Rezone From: M-2, Manufacturing District,
 
To: C-4, Commercial District.
 
SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established in the C-4, Commercial District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
