GREATER HILLTOP AREA COMMISSION RECOMMENDATION: Disapproval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The 1.87± acre site consists of one undeveloped parcel in the L-C-3, Limited Commercial District. The applicant requests the AR-1, Apartment Residential District to allow for a multi-unit residential development. The site is within the planning boundaries of the Hilltop Land Use Plan (2019), which recommends “Low-Medium Density Residential” land uses at this location. The requested AR-1 District will allow multi-unit residential development that is compatible with the density and development standards of adjacent residential developments west and south of the subject site and is aligned with the City’s objective to provide more housing in all areas of the city. Staff also notes that the underlying L-C-3 district allows multi-unit residential units above first-floor commercial uses with no density limitation. Concurrent Council variance (Ordinance #3001-2025; CV25-054) proposes a 48-unit apartment complex, with reduced minimum building setback line along Hall Road.

WHEREAS, application #Z25-028 is on file with the Department of Building and Zoning Services requesting rezoning of 1.87± acres from L-C-3, Limited Commercial District, to AR-1, Apartment Residential District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the Greater Hilltop Area Commission recommends disapproval of said zoning change; and
WHEREAS, the City Departments recommend approval of said zoning change because the requested AR-1, Apartment Residential District will allow multi-unit residential development that is consistent with surrounding zoning and development patterns, and the proposal also aligns with the City’s objectives for providing more housing units; now, therefore:
