BACKGROUND: The purpose of this legislation is to authorize the Director of the Department of Public Utilities to enter into a sole-source maintenance contract with Agilent Technologies, Inc. The Water Quality Analysis Lab (WQAL) has various scientific instruments that require maintenance and repair services by an authorized service provider. This equipment is used to analyze collected water samples as necessary for regulatory compliance.

Title
To authorize the Director of the Department of Public Utilities to enter into a sole-source contract for maintenance and repair services for WQAL instruments with Agilent Technologies, Inc.; and to authorize the expenditure of $63,005.40 from the 2025 Division of Water Operating Fund. ($63,005.40)
Body
WHEREAS, the Division of Water has a need for maintenance and repair services with Agilent Technologies, Inc., in order to ensure timely repair of broken equipment and adequately protect the City's investment; and
WHEREAS, Agilent Technologies, Inc. is the sole-source service provider of the equipment and has provided a quote for a service and maintenance agreement; and
WHEREAS, due to the proprietary nature of the repair and maintenance services, it is necessary to enter into this contract with Agilent Technologies, Inc. in accordance with the sole source provisions of Columbus City Code Chapter 329; and
WHEREAS, funds are budgeted for this purpose in the Division of Water 2025 Operating Fund; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities that it is necessary to authorize the Director of the Department of Public Utilities to enter into a sole-source contract for maintenance and repair services with Agilent Technologies, Inc.; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Public Utilities be and is hereby authorized to enter into a sole-source contract for maintenance and repair services for Water Quality Analysis Lab instruments with Agilent Technologies, Inc.
SECTION 2. That said firm shall conduct the work to the satisfaction of the Director of the Department of Public Utilities and the Administrator of the Division of Water.
SECTION 3. That the award of the contract described is in compliance with the sole source provisions of Section 329 of the Columbus City Codes to allow the aforementioned contract with Agilent Technologies, Inc.
SECTION 4. That the expenditure of $63,005.40, or so much thereof as may be needed, is hereby authorized in the Division of Water 2025 Operating Fund in object class 03 (services) per the accounting codes in the attachment to this ordinance.
SECTION 5. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, the City Auditor shall establish such account codes as necessary.
SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 7. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
