Explanation
1. BACKGROUND
The City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the acquisition of rights of way for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road Project (530103-100005/2552 DR. E). The project limits are Fairwood Avenue from Watkins Road to just north of Koebel Road, including alleys and side roads.
This project will lower the existing roadway profile to provide for positive drainage and full depth pavement replacement. Also included with this project are the installation of concrete curb and gutter, a new storm sewer system, pavement markings, signing, ADA compliant sidewalks and curb ramps.
Initial acquisition funding for this project, in the amount of $250,000.00, was authorized pursuant to Ordinance 0586-2011, passed April 25, 2011. The City Attorney's Office, Real Estate Division, has requested an additional $50,000.00 to complete acquisition of the rights-of-way needed for this project.
2. FISCAL IMPACT
Monies to provide funding for this expense are available within the Streets and Highways G.O. Bonds Fund.
3. EMERGENCY DESIGNATION
Construction plans for this improvement project are complete and fully signed. Construction of this Arterial Street Rehabilitation project is contingent upon completion of the right-of-way acquisition. Emergency action is requested so the City Attorney's Real Estate Division can complete right-of-way acquisition this year.

To authorize the City Attorney's Office, Real Estate Division, to complete right-of-way acquisition for the Arterial Street Rehabilitation-Fairwood Avenue/Watkins Road-Koebel Road project; to amend the 2011 C.I.B.; to authorize the appropriation of 26.17 and transfer and expenditure of $50,000.00 within the Streets and Highways G.O. Bonds Fund for right-of-way acquisition costs relative to the Arterial Street Rehabilitation-Fairwood Avenue/Watkins Road-Koebel Road project; and to declare an emergency. ($50,000.00)

WHEREAS, the City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the acquisition of rights-of-way for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road Project; and
WHEREAS, the purpose of this project is to lower the existing roadway profile to provide for positive drainage and full depth pavement replacement; install concrete curb and gutter, a new storm sewer system, pavement markings, signing, ADA compliant sidewalks and curb ramps; and
WHEREAS, , in the amount of $250,000.00, was authorized by Ordinance 0586-2011; and
WHEREAS, Ordinance 0586-2011, passed April 25, 2011 authorized the expenditure of $250,000.00 by the City Attorney's Office, Real Estate Division, for the initial acquisition funding for this project; and
WHEREAS, the City Attorney's Office, Real Estate Division, has requested an additional $50,000.00 to complete acquisition of the right-of-way needed for this project; and
WHEREAS, because the construction plans for this roadway improvement project have been completed and signed construction of this project can begin upon completion of the right-of-way acquisition; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in that it is immediately necessary to authorize City Attorney's office Real Estate Division to expend the additional funds necessary to complete acquisition of the rights-of-way needed for the Arterial Street Rehabilitation Fairwood Avenue/Watkins Road-Koebel Road Project for the preservation of the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Attorneys' Office, Real Estate Division, be and is hereby authorized to expend those funds necessary to complete acquisition of the rights-of-way needed for the Arterial Street Rehabilitation Fairwood Avenue/Watkins Road-Koebel Road Project.
SECTION 2. That the 2011 Capital Improvement Budget authorized by ordinance 0266-2011 be and is hereby amended due to cancelled encumbrances from completed project as follows:

SECTION 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
