CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of three parcels developed with warehouse and office uses in the C-4, Commercial District. The requested CPD, Commercial Planned Development District allows all C-4 uses for the building at 951 Frebis Avenue, and only allows an accessory parking lot on parcel 010-087188, as shown on the submitted site plan. . The CPD text establishes use restrictions and includes supplemental development standards that address site access and parking. The site is within boundaries of the South Side Plan (2014), which recommends “Neighborhood Commercial” land uses for this location and includes early adoption of Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018). The proposed CPD district will not introduce an incompatible use to the area, and is consistent with the Plan’s recommendation for “Neighborhood Commercial” land uses. The site plan includes adequate landscaping and screening of the parking lot from Oakwood Avenue and adjacent residential properties, consistent with C2P2 Design Guidelines.

WHEREAS, application #Z24-017 is on file with the Department of Building and Zoning Services requesting rezoning of 0.40± acres from C-4, Commercial District, to CPD, Commercial Planned Development District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the Columbus South Side Area Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval of said zoning change because the requested CPD, Commercial Planned Development District is consistent with the South Side Plan’s recommendation of “Neighborhood Commercial” land uses, and includes a site design consistent with C2P2 Design Guidelines; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
951 FREBIS AVE. (43223), being 0.40± acres located on the south side of Frebis Avenue; 50± feet east of Oakwood Avenue, and being more particularly described as follows:
Situated in the City of Columbus, County of Franklin and State of Ohio and bounded and described as follows:
Being Lots Numbered Fifty-eight (58), Fifty-nine (59) and Sixty (60) of EARHART ADDITION, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 19, Page 51, Recorder's Office, Franklin County, Ohio and a permanent easement reserved across an area approximately Ten (10) feet in width along the entire east side of Lot Fifty-seven (57) for the purposes of ingress and egress to and for the benefit of Lots Fifty-eight (58) and Fifty-nine (59) of said Earhart Addition. Said easement is recorded at Vol. 02535, page B-13, Recorder's Office, Franklin County, Ohio.

SECTION 2. That a Height District of thirty-five (35) feet is hereby established on the CPD, Commercial Planned Development District on this property.

1. INTRODUCTION: The site is located at the south side of Frebis Avenue. The commercial building was constructed in 1978 and has had a variety of different tenants. The owner/applicant would like to turn one of the tenant spaces into a restaurant. The owner/applicant owns the vacant lot south of the alley and that lot is providing necessary parking and therefore the need to link the parcels together through the CPD.
2. PERMITTED USES: Those uses permitted under Section 3356.03, C-4 Commercial of the Columbus City Code. The only permitted use on parcel 010-087188 is for associated parking for those uses on parcels 010-087186 and 010-087187, located north of the alley.
3. DEVELOPMENT STANDARDS: Unless otherwise indicated in the written text, the applicable development standards shall be those standards contained in Chapter 3356, C-4, Commercial of the Columbus City Code.
A. Density, Height, Lot and/or Setback commitments.
The parking setback along Frebis Avenue will be 5’.
B. Access, Loading, Parking and/or other Traffic related commitments.
1. A portion of parking for site is south of the building, across the alley and identified by parcel number 010-087188. The parcel shall be associated with the building parcels to provide the parking required by CCC 3312.49.
2. The number of parking spaces to serve the site is 22.
C. Buffering, Landscaping, Open space and/or Screening commitments.

All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the C-4 Commercial District and any variance to the sign requirements shall be submitted to the Columbus Graphics Commission for consideration.
G. Miscellaneous commitments:
1. CPD Criteria.
a) NATURAL ENVIRONMENT: The site has an existing building.
b) EXISTING LAND USES: To the north is a house zoned C-4; to the east is an office building; to the west is a house zoned C-4 and to the south is the parking lot for the site and single family homes south of it.
c) TRANSPORTATION AND CIRCULATION: Access to the site shall be via Frebis Avenue, Oakwood Avenue and an alley to the east and south.
d) VISUAL FORM OF THE DEVELOPMENT: The building and parking areas are existing.
e) VIEW AND VISIBILITY: In the development of the subject property and the location of the buildings and access points consideration has been given to the visibility and safety of the motorists and pedestrians.
f) PROPOSED DEVELOPMENT: Commercial uses in the existing building and the adjacent parking lot.
g) EMISSIONS: No adverse effects from emissions shall result from the proposed development.
h) BEHAVIOR PATTERNS: The proposed development would serve the neighboring community.
2. Site Plan
The Subject Site shall be developed in accordance with the site plan. The site plan may be slightly adjusted to reflect engineering, topographical or other site data developed at the time of development and engineering plans are completed. Any slight adjustment to the plan shall be reviewed and may be approved by the Director of the Department of Development or his designee upon submission of the appropriate data regarding the proposed adjustment.
H. Modification of Code Standards
1. 3312.49 - to reduce the required number of parking spaces from 35 to 22 (13 space reduction).
2. 3312.27(4) - to reduce the parking setback to 5’ from 10’ (a reduction of 5’).
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
