Rezoning Amendment Z94-115A
 
Ordinance #802-1995, passed April 24, 1995, rezoned 9.12± acres from the L-C-3, Limited Commercial District to the L-C-4, Limited Commercial District to permit limited commercial development.  That legislation established specific development standards addressing use restrictions, setbacks, landscaping, and screening, including provisions for mounding and street tree plantings along the Nike Drive and Hilliard-Rome Road frontages.  The applicant desires to change the landscaping requirements along the Hilliard-Rome Road frontage due to the location of an electrical easement.  This ordinance will amend Ordinance #802-1995 by repealing Section 3, and replacing it with a new Section 3 with a modified limitation overlay text.  All other use restrictions and development standards established by Ordinance #802-1995 will remain in effect.

Body
 
WHEREAS, Ordinance #802-1995, passed April 24, 1995 (Z94-115), established the L-C-4, Limited  Commercial District on property located at 5301 NIKE DRIVE (43026), being 9.12± acres located at the southeast corner of Nike Drive and Hilliard-Rome Road, from the L-C-3, Limited Commercial District; and
 
WHEREAS, it is necessary to amend Ordinance #802-1995 to modify the landscaping requirements along the Hilliard Rome Road frontage; and,
 
WHEREAS, all other aspects of the L-C-4 text contained in Ordinance #802-1995 are unaffected by this amendment and remain in effect, now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the existing Section 3 of Ordinance #802-1995, passed on April 24, 1995 (Z94-115) be hereby repealed and replaced with a new Section 3 reading as follows:
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved L-C-4, Limited Commercial District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said text being titled, "LIMITATION TEXT," dated September 6, 2006, and signed by Jim Krier, Applicant, and the text reading as follows:

PERMITTED USES:
 
Those uses permitted in Section 3355.02 3356 of the Columbus City Code with the following exclusions:
 
      Adult bookstore, adult motion picture theater or adult only entertainment establishment
      Apartment facilities over room used for permitted use
      Assembly Hall
      Cabaret
      Dance Hall
      Experimental Lab
      Greenhouse and nursery for horticulture and sale of any products grown on premises
      Motor Bus Terminal
      Newspaper Printing
      Night Club
      Off-premises graphics (billboards)
      Poultry Killing
      Private Club
      Public Garage
      Stable
      Tinsmith
      Used Automobile Lot (unless part of a new car automobile dealership)
 
Unless otherwise indicated in this text the applicable development standards are those standards contained in chapter 3355 3356 of the Columbus City Code.
 
DEVELOPMENT STANDARDS:
 
1.      Lighting in parking areas shall be of the cutoff variety on poles not exceeding 20 feet in height.  Lighting in maneuvering or loading areas shall be either to the parking area standard or shall be wall mounted and of cutoff or downlight design.  All exterior lighting shall be designed or constructed so that glare into residential areas is avoided.
 
2.      Within the setback area along Rome Hilliard Road and Nike Drive, an undulating mound of two to three feet in height sodded or seeded, shall be installed except at the curbcuts.  The mound shall be substantially continuous, but if broken must contain plantings of similar height in the gap area.  The mounding and screening requirement is abated to the degree that safe sight triangles are inhibited at curb cuts. No mounding is permitted along Hilliard-Rome Road due to an existing American Electric Power Easement.
 
 
a.      In the setback area along Rome Hilliard Road and Nike Drive, at 35 feet on-center intervals, shall be planted deciduous trees of a minimum caliper diameter of 2.5 inches. Along Hilliard-Rome Road, no trees are permitted to be planted due to an existing American Electric Power easement.
 
b.      The property owner shall maintain the required landscaping in an orderly and healthy fashion.  Any dead materials shall be replaced within a reasonable amount of time, weather permitting with like-kind materials which meet the size requirements outlined in this text.
 
c.    The total of ten (10) 2 ½" caliper deciduous trees which were specified to be planted along Hilliard-Rome Road at 35' intervals are to be planted between the east side of the retention pond and the west side of the access drive that runs off of Nike Drive. This is located in the northeast portion of the property.
 
 
3.      There shall be a ten foot wide buffer strip along the entire east and south side of the subject site.  Within this buffer strip evergreen trees, five feet in height at installation, shall be planted twenty feet on center.  Where this buffer strip is subject to the parking lot additional landscaping, fencing, walls or mounding (individually or in any combination) shall be added to the buffer strip to meet the parking lot screening requirements.  Any fence or wall shall be placed on the interior edge of the buffer strip.  In addition where this buffer area is adjacent to loading or service areas then a six foot high opaque fence shall be installed along the interior edge of the buffer strip.
 
4.      No off premises graphics (billboard) or roof top sign permitted; provided however, that this prohibition against billboards shall not be construed to prohibit or limit on-premises signage otherwise allowable by the City's graphic code.
 
5.      Setbacks from the right-of-way along Rome Hilliard Road shall be 25 feet for parking.
 
6.      All dumpsters shall be screened on three sides with either a wood fence or a wall to a height of six feet.
 
7.      Any automotive repair or maintenance facility shall not be located within one hundred feet of the adjacent residentially zoned property.
 
SECTION 2.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
