Explanation
 
Background:  TGI FRIDAY'S INC. by RONALD O. CARLISLE its Senior Architect, has submitted the plat titled HENDERSON ROAD, THE ESTABLISHMENT OF AN ACCESS IN THE NORTHERLY LIMITED ACCESS RIGHT-OF-WAY LINE THEREOF, CITY OF COLUMBUS, to the City Engineer's Office for review and approval.  This plat has been reviewed and approved by the City Engineer.  The following legislation allows the City to accept said plat for property located at the northeast corner of Henderson Road and Kenney Road.
 
Fiscal Impact: The City will receive a total of $53,803.81 to be deposited in Fund 748, the General Permanent Improvement Fund, Project 537650 (General Roadway Street Improvements) as consideration for the requested access point

To accept the plat titled HENDERSON ROAD, THE ESTABLISHMENT OF AN ACCESS IN THE NORTHERLY LIMITED ACCESS RIGHT-OF-WAY LINE THEREOF, CITY OF COLUMBUS, from TGI FRIDAY'S INC. by RONALD O. CARLISLE its Senior Architect and to declare an emergency.  
 
 
Body:
 
 
WHEREAS, the plat titled HENDERSON ROAD, THE ESTABLISHMENT OF AN ACCESS IN THE NORTHERLY LIMITED ACCESS RIGHT-OF-WAY LINE THEREOF, CITY OF COLUMBUS (hereinafter "plat"), has been submitted to the City Engineer's Office for approval and acceptance; and
 
WHEREAS, TGI FRIDAY'S INC. by RONALD O. CARLISLE its Senior Architect, owner of the platted land, desires to establish a vehicular access point from Henderson Road and a certain 2.405 acre tract now owned by TGI FRIDAY'S INC.; and
 
WHEREAS, after investigation and negotiation the City has determined there will be no detrimental effect upon the citizens of the City of Columbus if this limited access is broken to allow for ingress onto the TGI FRIDAYS, Inc property; and
 
WHEREAS, a value of  $53,803.81 was established for this break in the right-of-way by the Department of Law, Real Estate Division; and,
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance to permit the developer to expediate the commencement and completion of the improvement for the immediate preservation of the public peace, property, health and safety; and,
 
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the plat titled HENDERSON ROAD, THE ESTABLISHMENT OF AN ACCESS IN THE NORTHERLY LIMITED ACCESS RIGHT-OF-WAY LINE THEREOF, CITY OF COLUMBUS on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
 
Section 2.      That the $53,803.51 to be received by the City as consideration for the requested access point shall be deposited in Fund 748, the General Permanent Improvement Fund, Project 537650 (General Roadway Street Improvements).
 
Section 3.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
