Explanation
Background:
On June 11, 2007, the County, City, and The Columbus Zoological Park Association, Inc. ("Zoo") entered into an Amended and Restated Lease Agreement, in order to restate, amend, and consolidate prior lease agreements and make certain other necessary changes to the zoo lease. The Amended and Restated Lease also extended the prior lease's term through December 31, 2037.
The Zoo is seeking a grant from the ODNR which requires certain changes be made to the lease. This proposed admendment , entitled First Amendment to The Amended and Restated Lease Agreement, modifies the lease by incorporating terms required by the grant agreement thus allowing the Zoo to obtain the ODNR grant .
Emergency action is requested to allow this project, which will benefit the City of Columbus, to proceed without delay.

To authorize the Executive Director of the Recreation and Parks Department to execute a First Amendment to the Amended and Restated Lease Agreement by, among and between the City, the Board of County Commissioners of Franklin County and The Columbus Zoological Association, and to declare an emergency.

WHEREAS, on June 11, 2007, the Board of Commissioners of Franklin County("Franklin County"), the City, and The Columbus Zoological Park Association, Inc. ("Zoo") entered into an Amended and Restated Lease Agreement, in order to restate, amend, and consolidate prior lease agreements and make certain other necessary changes to the zoo lease extending it through July 31, 2037; and
WHEREAS, this proposed First Amendment to the Amended and Restated Lease Agreement will incorporate certain provisions required by ODNR in order for the Zoo to receive grant funds for the construction of improvements at the Zoo; and
WHEREAS, emergency action is required to allow this project to proceed without delay; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Executive Director of the Recreation and Parks Department be, and is hereby, authorized to execute a First Amendment to the Amended and
Restated Lease Agreement by, among and between the City,Franklin County and the Zoo which amendment modifies the lease to incoprporate certain terms necessary for the Zoo to obtain grant funds from ODNR.
Section 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
