GERMAN VILLAGE COMMISSION RECOMMENDATION: Approval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one parcel developed with a mixed-use building, as approved with Ordinance #0084-02 (CV01-052), passed on February 4, 2002, in the R-2F, Residential District. The requested Council variance will add new neighborhood-scale commercial uses to the already approved uses listed in Ordinance #0084-02. This ordinance includes a condition that commercial uses will continue to be limited to the ground floor of the building. A variance to reduce required parking from three spaces to zero spaces is also included. There is no Council adopted land use recommendation for this property; however, the proposed allowable uses are consistent with other neighborhood-scale commercial uses located in mixed-use buildings throughout German Village.

To grant a Variance from the provisions of Sections 3332.037, R-2F residential district; and 3312.49, Required parking, of the Columbus City Codes; for the property located at 657 MOHAWK ST. (43206), to allow limited neighborhood-scale commercial uses with reduced parking in the R-2F, Residential District (Council Variance #CV25-110), and to repeal Ordinance #0084-02, passed February 4, 2002 (Council Variance #CV01-052).

WHEREAS, by application #CV25-110, the owner of property at 657 MOHAWK ST. (43206), is requesting a Council variance to allow limited neighborhood-scale commercial uses with reduced parking in the R-2F, Residential District; and
WHEREAS, Section 3332.037, R-2F residential district, prohibits commercial uses, while the applicant proposes to allow limited neighborhood-scale commercial uses within the first floor of the existing building (approximately 500 square feet); and
WHEREAS, Section 3312.49, Required parking, requires two parking spaces for the single-unit dwelling use and one parking space per 500 square feet of commercial space, a total requirement of three spaces, while the applicant proposes no parking spaces; and
WHEREAS, the German Village Commission recommends approval; and
WHEREAS, the City Departments recommend approval because the requested neighborhood-scale commercial uses are consistent with similar mixed-use buildings in German Village; and
WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed commercial uses; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 657 MOHAWK ST. (43206), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance from the provisions of Sections 3332.037, R-2F residential district; and 3312.49, Required parking, of the Columbus City Codes; is hereby granted for the property located at 657 MOHAWK ST. (43206), insofar as said sections prohibit commercial uses in the R-2F, Residential District, with a parking space reduction from three required spaces to zero provided spaces; said property being more particularly described as follows:
657 MOHAWK ST. (43206), being 0.02± acres located at the southwest corner of East Sycamore Street and Mohawk Street, and being more particularly described as follows:
Situated in the State of Ohio, County of Franklin, and in the city of Columbus.
Being part of Half-Section No. 27, Township 5, Range 22, Refugee Lands in said City:
Beginning at the southwest comer of Sycamore and Mohawk Streets in said city; thence west along the south line of Sycamore Street Ninety (90) feet to a point; thence south parallel with the west line of Mohawk Street to a point in the south line of a tract of land conveyed by William Hettesheimer to Peter Hettesheimer; thence easterly with the south line of said Hettesheimer's tract to a point in the west line of Mohawk Street; thence north Eighteen (18) feet to the place of beginning;
EXCEPTING THERE FROM THE FOLLOWING DESCRIBED PREMISES:

Beginning at an iron pin in the south line of Sycamore Street, said point of beginning being N. 88 deg. 30' W 49.20' along the south line of Sycamore Street from an iron pin at the intersection of the South line of Sycamore Street and the west line of Mohawk Street; thence N. 88 deg. 30' W.
39.15' to an iron pin in the south line of Sycamore Street at the northeast comer of property owned by Raffaele and Caterina Trespasso; thence S. 2 deg. 01' E. 23.03' along the east property line of the said Trepasso's to an iron pin at the northwest comer of property owned by Henrietta Rosenthal; thence along the said Rosenthal's north property line N. 89 deg. 15' E. 38.32' to a point which is 0.42' right (or south) of an iron pin; thence N. 0 deg. 00' E. 21.49' (passing the last mentioned iron pin at 0.42') to an iron pin the point of beginning, on the south line of Sycamore Street.

SECTION 3. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed commercial uses.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
SECTION 5. That Ordinance #0084-02, passed February 4, 2002, be and is hereby repealed.
