Explanation
BACKGROUND:
As a result of an extensive, city-wide, code review process conducted by Lexis-Nexis, a series of code changes were recommended in an effort to remove errors and conflicts from the Columbus City Codes. These changes are designed not to change the content or intent of the code but rather to correct simply typographical errors and conflicting cross references when present.
This ordinance authorizes the amendment of Section 215.02 of the Columbus City Code that establishes the Duties of Director and Deputy Directors of the Department of Development. The uncorrected version contained a sentence fragment in the portion of the code that designated the deputy director as serving in the absence of the director. The proposed code change adds the word 'Deputy' to clarify who would serve in the absence of the Director as well as making needed grammar corrections in the remaining sentences.

WHEREAS, this ordinance authorizes the amendment of Chapter 215.02 of the Columbus City Code that establishes the Duties of Director and Deputy Directors of the Department of Development; and

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That Section 215.02 of the Columbus City Codes, 1959, is hereby amended to read as follows:
215.02 Duties of director and deputy directors.
The director of the department shall be appointed by the mayor and shall serve at the pleasure of the mayor with a salary fixed by ordinance of council. The director of development shall have all powers and duties connected with and incident to the appointment, regulation and government of the department of development. The deputy director shall serve in the absence of the director.
The director of the department of development shall have and exercise all powers, duties and functions given to a city planning commission, city platting commission and platting commissioner by Chapter 711 of the Ohio Revised Code and Sections 735.17 to 735.26, inclusive, of the Ohio Revised Code, notwithstanding the provisions in Section 713.03 of the Ohio Revised Code to the contrary.
Section 2. That prior existing Section 215.02 of the Columbus City Codes, 1959, is hereby repealed.
Section 3. That this ordinance shall take effect and be in force from and after the earliest period provided by law.
