Explanation
 
Background:  Ordinance 1515-2006 approved by Council on September 11, 2006 authorized the Franklin County Municipal Court Clerk to enter into the first year of a three-year contract with Sterling Data Center LLC for remote data back up recovery services for the Municipal Court Clerk Courtview and Dell server databases.  The service provides the Municipal Court Clerk with near "real time" back up, quicker recovery from data loss, and a more comprehensive disaster recovery system for viable data restoral.
 
This ordinance authorizes a supplemental appropriation of $29,125.00 from the unappropriated balance of the Franklin County Municipal Court Clerk computer fund; authorizes the Municipal Court Clerk to enter into the second year of a three year contract with Sterling Data Center LLC for remote data back-up recovery services; authorizes an expenditure of $29,125.00 from the Clerk's computer fund and declares an emergency.
 
Emergency:  This ordinance is being submitted as an emergency measure for the continuity of the comprehensive disaster recovery system for the Municipal Court Clerk databases.

Whereas, this ordinance will allow the Franklin County Municipal Court Clerk to appropriate said funds within the appropriated balance of the Municipal Court Clerk computer fund; and
 
Whereas, sufficient funds are available within the Municipal Court Clerk computer fund; and
 
Whereas,  on September 11, 2006, Council approved ordinance 1515-2006 to establish a three year contract with Sterling Data Center LLC to purchase remote data back up recovery services for the  Franklin County Municipal Court Clerk databases; and
 
Whereas, it is necessary to enter into the second year of a three year contract to continue remote data back up recovery services for the Franklin County Municipal Court Clerk's databases; and,
 
Whereas, the contact was awarded pursuant to the provisions of Columbus City Code, section 329.14; and
 
Whereas, an emergency exists in the usual daily operations of the Franklin County Municipal Court Clerk's office  in that it is immediately necessary to enter into contract with Sterling Data Center, LLC thereby preserving the public health, peace, property, safety, and welfare; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  The Franklin County Municipal Court Clerk and is hereby authorized to enter into the second year of a three year contract with Sterling Data Center LLC for the purchase of remote data back-up recovery services for the Clerk's databases.
 
Section 2.  That from the unappropriated monies within the Franklin County Municipal Court Clerk computer fund and from all monies estimated to be deposited into said fund, the sum of $29,125.00 be and is hereby appropriated within the Clerk computer fund 227, subfund 02, organization 2601, oca 260208, object level 1-03, object level  3 - 3336 - $29,125.00.
 
Section 3.  That the expenditure of $29,125.00 or so much thereof as may be needed is hereby authorized to be expended from the Franklin County Municipal Court Clerk computer fund, fund number 227, organization 2601, subfund 002, oca code 260208, object level  1 - 03, object level  3 - 3336 - $29,125.00.
 
Section 4.  That the contract was awarded pursuant to the provisions of Columbus City Code, section 329.14.
 
Section 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take in effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
