WHEREAS, application #Z03-112 is on file with the Building Services Division of the Department of Development requesting rezoning of 4.03± acres from L-AR-12, Limited Apartment Residential District, to L-M, Limited Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the proposed L-M, Limited Manufacturing District is consistent with the zoning and development patterns of the area and includes appropriate use restrictions and development standards to mitigate any negative offsite impacts to the adjacent multi-family uses, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

INTRODUCTION:
 
The site is 4.02+ acres located on the north side of Hamilton Square Boulevard and the west side of Lakeview Crossing. The current L-AR-12 zoning was established by Ordinance 077-98, passed February 9, 1998 (Z97-113). Applicant requests to rezone the site to the L-M District for consistent development with abutting L-C-4 and L-M zoning and development inside of the street loop consisting of Hamilton Square Boulevard, Lakeview Crossing and Professional Parkway rather than developing the 4.02 acres site as a residential site isolated from other larger AR-12 tracts to the east and southeast.
 
1.       PERMITTED USES:  All uses permitted by Section 3363.01 of the Columbus Zoning Code, except a car wash. Retail commercial uses, as permitted in 3363.01, are also permitted subject to retail uses being associated with the primary use and occupying a maximum of 50% of the total building floor area. All uses of 3363.02 except a lumber yard, warehouse or storage in bulk of feed or fuel and all uses of 3363.02 (c). All uses of 3363.03, except a stable, railroad yard and wagon shed. Laboratories, as listed in 3363.04. All uses of 3363.08, except cigar or cigarette manufacture; dyeing plant; leather goods manufacture; monument shop and paint and shellac manufacture.
2.      DEVELOPMENT STANDARDS:
 
A.      Density, Height, Lot and/or Setback Commitments.
 
(1)      The height district shall be H-35 or as permitted by Section 3309.142 of the
Columbus City Codes.
 
B.      Access, Loading, Parking and/or Other Traffic Related Commitments.
 
(1)       Parking for retail uses shall be provided specifically on the basis of total retail sales floor area, including showrooms and display area.
      
C.      Buffering, Landscaping, Open Space and/or Screening Commitments.
 
(1)      Truck loading and unloading shall be internally oriented and/or screened from view.
 
(2)      Street trees at least 2 ½ inches in caliper at installation shall be planted at 40 feet
on center along Hamilton Square Boulevard and Lakeview Crossing.
 
(3)      Street trees and other plant material shall be maintained in good condition. Dead,
dying or diseased plant material shall be replaced as soon as reasonably possible.
 
(4)      Headlight screening shall be provided adjacent to any parking space along Hamilton Square Boulevard and Lakeview Crossing that is located less than 100 feet from a residential district. Headlight screening shall be provided to a minimum height of 36 inches and may consist of mounding, landscaping, low walls and/or fencing.
 
D.      Building, Design and/or Interior-Exterior Treatment Commitments. N/A
 
E.      Dumpsters, Lighting, Outdoor Display Areas and/or Other Environmental Commitments.
 
(1)      All lighting except accent lighting, lighting for signs and pedestrian level lighting
shall be provided by cut-off fixtures (down lighting). Parking lot lighting shall not exceed
a height of 18 feet within 100 feet of a residential zoning district and shall not exceed 24
feet otherwise.
 
(2)      All parking lot light fixtures, poles and fixtures shall be from the same or similar manufacturer's type to insure aesthetic compatibility.
            
(3)      All dumpsters shall be screened in accordance with the requirements of Section 3342.09, Columbus City Codes. Dumpster screening shall be maintained in a condition of good repair and maintenance. Dumpster screening shall be accomplished with any combination of screening by adjacent building and opaque fence, masonry wall and/or landscaping to a minimum height of six (6) feet.
 
(4)       Outside storage shall be fully screened from view to the height of the storage, if any. No outside storage will be located between any public street and the front building setback.
 
F.      Graphics and Signage Commitments.
 
All graphics shall conform to Article 15 of the Columbus City Code, as it applies to the M, Manufacturing District. Any variance to the applicable requirements of the M, Manufacturing District, shall be submitted to the Columbus Graphics Commission.
      
 
G.      Miscellaneous Commitments. N/A
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
