Explanation
BACKGROUND: This legislation authorizes the Director of the Department of Public Utilities to modify to add funding to an existing contract for Power Distribution Installation and Restoration Services with Danbert Electrical Corporation in the amount of $800,000.00 for the Division of Power. This work consists of providing labor and equipment for removing and setting poles, installing and removing conductors and other such work as necessary at various locations within the Columbus Electric System on an as needed basis. Funds in the amount of $2,000.00 will also be encumbered with the Department of Public Service for Prevailing Wage Services.
The Department of Public Utilities solicited competitive bids for Power Distribution Installation and Restoration in accordance with the relevant provisions of Section 329 (RFQ023467). Three hundred and fifteen (315) vendors were solicited. Five bids were received and opened on December 21, 2022. After a review of the bids, New River Electrical Corporation was the lowest bidder. However, they failed to meet the bid specifications requiring a 10% MBE/WBE goal which deemed the bid non-responsive. Danbert Electrical Corporation was the next lowest bidder and met all the specifications of the bid. The contract term is for three years through December 31, 2025. The contract language allows for a one (1) year renewal option upon mutual agreement, availability of funds, and approval by Columbus City Council. If unforeseen issues or difficulties are encountered that would require additional funding, a modification would be requested.
Ordinance Number 0259-2023 authorized establishing purchase agreement PA006359. This Ordinance will add funds for the 2024 budget year.
This Ordinance is being submitted in accordance with the relevant provisions of Chapter 329 of City Code.

The companies are not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
1. Amount of additional funds: Total amount of additional funds needed for this contract is $802,000.00. Total contract amount including this addition is $3,304,000.00.
2. Reasons additional funds were not foreseen: The need for additional funds were known at the time of the initial contract. This funding is to provide the additional funding necessary for the payment of services to be provided through December 31, 2025.
3. Reason other procurement processes were not used: Work under this modification is a continuation of services included in the scope of the original bid contract. No lower pricing/more attractive terms and conditions are anticipated at this time.
4. How cost was determined: The cost, terms and conditions are in accordance with the original agreement.
FISCAL IMPACT: $802,000.00 is budgeted and needed for this purchase. This ordinance is contingent on the passage of the 2024 Operating Budget, Ordinance 3012-2023.

To authorize the Director of the Department of Public Utilities to modify to add funding for a contract with the with Danbert Electrical Corporation for Power Distribution Installation and Restoration Services for the Department of Public Utilities, Division of Power and to provide for payment of prevailing wage services to the Department of Public Service, Design and Construction Division; and to authorize the expenditure of $802,000.00 from the Power Operating Fund. ($802,000.00)

WHEREAS, the Department of Public Utilities entered into contract for Power Distribution Installation and Restoration Services in accordance with Chapter 329 of the Columbus City Code, pursuant to solicitation, RFQ023467, with Danbert Electrical Corporation, being the most responsive, responsible and best bidder; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to modify to add funding to the contract for Power Distribution Installation and Restoration with Danbert Electrical Corporation; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to encumber and expend funds to provide for payment of prevailing wage services associated with said contract; and
WHEREAS, the expenditure of $802,000.00 or so much thereof as is needed for Power Distribution Installation and Restoration Services; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities to modify to add funding for the contract with Danbert Electrical Corporation for Power Distribution Installation and Restoration Services; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Utilities be and is hereby authorized to modify to increase funding for the contract Danbert Electrical Corporation for Power Distribution Installation and Restoration Services.
SECTION 2. That said firm shall conduct the work to the satisfaction of the Director of Public Utilities.
SECTION 3. That the expenditure of $802,000.00, or so much thereof as may be needed, is hereby authorized in Fund 6300 (Power Operating) in object class 03 Services per the accounting codes in the attachment to this ordinance.
SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.
SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
SECTION 6. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
