Explanation
The Public Service Department, Transportation Division, is engaged in the North High Street - Flint Road to Delaware County Line project. This project will widen High Street by one lane in each direction, add sidewalks, curb ramps and update the traffic signals. Initial funding for acquisition-related activities in the amount of $265,000.00 was authorized by Ordinance 0426-1998 passed February 23, 1998. Acquisition for this project is nearly completed with one parcel remaining to be acquired. At this time it is necessary to increase the initial funding to allow acquisition-related activities to resume. This legislation authorizes the City Attorney to expend an additional $50,000.00 or so much thereof as may be necessary for the acquisition of fee simple title and lesser interests in and to property needed for this roadway improvement project.
Fiscal Impact: Additional acquisition-related expenses are currently estimated to be $50,000.00 for this project. These costs are not budgeted per se but have been identified and are available from the cancellation of $229,513.81 from an old construction contract (EL031299-002) that has been completed and for which the funds are no longer needed. This ordinance transfers funds as appropriate between projects within the 1995, 1999, 2004 Voted Streets and Highways Fund.
Emergency action is requested because right-of-way acquisition and utility relocation activities that traditionally require two (2) years to complete must be finished before construction can begin. Construction of this project is currently scheduled to begin in early 2008, and is necessary to be under construction in 2008 to blend into the ODOT improvement of US 23/I-270 interchange proposed for construction at this same time. The Public Service Department, Transportation Division, would like the City Attorney's Office, Real Estate Division, to resume acquisition-related activities without delay so that construction of the proposed improvements can begin as currently scheduled.

To authorize the transfer of $50,000.00 between projects within the 1995, 1999, 2004 Voted Streets and Highways Fund; to authorize the City Attorney to expend an additional $50,000.00 for acquisition-related activities including the acquisition of fee simple title and lesser interests in and to property needed for the North High Street - Flint Road to Delaware County Line project for the Transportation Division; to authorize the expenditure of $50,000.00 or so much thereof as may be necessary from the 1995, 1999, 2004 Voted Streets and Highways Fund and to declare an emergency. WHEREAS, the Public Service Department, Transportation Division, is engaged in the North High Street - Flint Road to Delaware County Line project; and
WHEREAS, this project will widen High Street by one lane in each direction, add sidewalks, curb ramps and update the traffic signals; and
WHEREAS, initial funding in the amount of $265,000.00 allowing the City Attorney's Office, Real Estate Division, to hire professional services and begin acquisition of necessary right-of-way, was established pursuant to Ordinance 0426-1998, passed February 23, 1998; and
WHEREAS, acquisition for this project is almost complete with one parcel remaining to be acquired; and
WHEREAS, at this time it is necessary to increase the funding to allow acquisition-related activities to resume; and
WHEREAS, funds for this acquisition are not budgeted per se but have been identified and are available from the cancellation of $229,513.81 from an old construction contract (EL031299-002) that has been completed and for which the funds are no longer needed; and
WHEREAS, this ordinance transfers funds as appropriate between projects within the 1995, 1999, 2004 Voted Streets and Highways Fund; and
WHEREAS, this legislation authorizes the City Attorney to expend an additional $50,000.00, or so much thereof as may be necessary for the acquisition of fee simple title and lesser interests in and to property needed for this project; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the additional funds necessary to resume acquisition-related activities for the North High Street - Flint Road to Delaware County Line project without delay so that construction of this project can begin in early 2008, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor be and hereby is authorized to transfer $50,000.00 between projects within Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, as follows:

SECTION 2. That the City Attorney be and hereby is authorized to resume acquisition-related activities necessary to complete acquisition of fee simple title and lesser interests in and to those parcels needed for the North High Street - Flint Road to Delaware County Line project and to expend those funds required to pay related acquisition costs.
SECTION 3. That for the purpose of paying for said costs the City Attorney's Office, Real Estate Division, be and hereby is authorized to expend $50,000.00, or so much thereof as may be necessary from Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 644385 and Project 530161.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
