Explanation
BACKGROUND: This ordinance authorizes the Administrative and Presiding Judge of the Franklin County Municipal Court to enter into contract with Christy K. Radigan dba C & B Services, Inc. and authorizes the expenditure of up to $21,000 for mediation services for the Court.
In 1992, Christy K. Radigan became a volunteer in the Court's mediation program. In May of 2004, she was hired as a part-time staff member to provide coordinator services for the mediation program. In June 2005, her hours were increased to allow her to provide additional mediation services. Recently it was determined that Ms. Radigan, also on contract with another city agency could not be both on the city payroll and providing services on contract with another agency. However, Ms. Radigan is a highly skilled mediator and mediation trainer and the services she provides are vital to the success of the Court's program. The Court has determined that, for continuity of service, it is in its best interest to procure mediation services from Christy K. Radigan dba C & B Services, Inc. and as such, the Court requests that the competitive bidding provisions of the Columbus City Code be waived.
Emergency action is requested to allow the financial transaction to be posted in the city's accounting system as soon as possible. Up to date financial posting promotes accurate accounting and financial management.

FISCAL IMPACT: Funds for this ordinance were originally budgeted as personnel expenses within the Court's 2006 appropriations. A transfer of appropriation authority from the personnel category to the services category will be necessary.

Whereas, it is desirable to provide mediation services to parties coming to the Court that would otherwise resolve conflicts before a judge or magistrate; and
Whereas, the Court has determined that, for continuity of service, it is in its best interest to procure the needed services from Christy K. Radigan dba C & B Services, Inc.; and
Whereas, this ordinance is requested as an emergency to ensure the continuation of uninterrupted mediation services; and
Whereas, an emergency exists in the usual daily operation of the city, in that it is immediately necessary to waive the competitive bidding provisions of the Columbus City Code and authorize the Administrative and Presiding Judge of the Franklin County Municipal Court to enter into contract and authorize the expenditure with Christy K. Radigan dba C & B Services, Inc. for provision of mediation services, thereby preserving the public health, peace, property, safety and welfare, Now, Therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That the Administrating and Presiding Judge of the Franklin County Municipal Court be and is hereby authorized and directed to enter into contract with Christy K. Radigan dba C & B Services, Inc. for mediation services in an amount up to $21,000.
Section 2. That the City Auditor be and is hereby authorized and directed to transfer $21,000 within the 2006 general fund appropriations of the Franklin County Municipal Court, fund number 010, department number 2501, as follows:

Section 3. That the expenditure of an amount up to $21,000 or as much thereof as may be necessary is hereby authorized from the general fund, fund number 010, Franklin County Municipal Court, department number 2501, oca 250159, object level 1 - 03, object level 3 - 3346.
Section 4. That in accordance with 329.27 of the Columbus City Code, this Council finds the best interest of the city is served by waiving, and does hereby waive Section 329.06 (Competitive Sealed Bidding) of the Columbus City Code.
Section 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
