Explanation
BACKGROUND:
This ordinance approves the acceptance of certain territory (AN25-016) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on August 11, 2025. City Council approved a service ordinance addressing the site on July 28, 2025. Franklin County approved the annexation on September 23, 2025 and the City Clerk received notice on October 3, 2025.
FISCAL IMPACT:
Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

WHEREAS, a petition for the annexation of certain territory in Franklin Township was filed on behalf of Jose Rodrigo Hernandez on August 11, 2025; and
WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on September 23, 2025; and
WHEREAS, on October 3, 2025, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and
WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and
WHEREAS, it has become necessary in the usual daily operation it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That the annexation proposed by Jose Rodrigo Hernandez in a petition filed with the Franklin County Board of Commissioners on August 11, 2025 and subsequently approved by the Board on September 23, 2025 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:
Situated in the State of Ohio, County of Franklin, Township of Franklin, lying in Virginia Military Survey No. 971, and being all of lot 70 and part of lot 71 of Eureka Park Addition, of record in Plat Book 19, Page 63, and being conveyed to Jose Rodrigo Hernandez, by deed of record in Instrument Number 201601220007910, being bounded and more particularly described as follows:
Beginning, at the southeasterly corner of said lot 70, the southwesterly corner of lot 69 of said Eureka Park Addition, and on the northerly City of Columbus Corporation Line, established by Ordinance Number 17-73 and recorded in Misc. Record 158, Page 516, and on the northerly line of Briggs Road (width varies);
Thence Westerly, a distance of approximately 92 feet, along the northerly City of Columbus Corporation Line (Ord. No. 17-73), the southerly line of said Hernandez tract, and along the southerly line of said lots 70 and 71, to a point, at the southwesterly corner
of said Hernandez tract, and the southeasterly corner of a tract of land conveyed to Franklin Township Board of Trustees, by deed of record in Deed Book 2008, Page 238;
Thence Northerly, a distance of approximately 150 feet, across said lot 71, and along the line common to said Hernandez and Franklin Township Board of Trustees tracts, to a point, at the northerly common corner of said Hernandez and Franklin Township Board of Trustees tracts, on the northerly line of said lot 71, and on the southerly line of a 15 feet wide alley (P.B. 19, Pg. 63);
Thence Easterly, a distance of approximately 97 feet, along the northerly line of said lot 71 and 70, the northerly line of said Hernandez tract, and the southerly line of said alley, to a point, at the northeasterly corner of said lot 70, the northeasterly corner of said Hernandez tract, the northwesterly corner of lot 69 of said Eureka Park Addition, and being conveyed to Julia Hildreth Parker, by deed of record in Instrument Number 202003120036868;
Thence Southerly, a distance of approximately 150 feet, along the line common to said lots 69 and 70, to the Point of Beginning, containing approximately 0.3 acres, more or less.
The total perimeter of Annexation is 489 feet, of which 92 feet is contiguous with the City of Columbus, giving 18.8 percent perimeter contiguity.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
