APPLICANT:  Robert J. Galli and Mark A. Galli; c/o David E. Slagle, Agent; 3011 Columbus Street; Grove City, OH 43123.
      
PROPOSED USE:  Single-family residential development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on September 14, 2006.
 
GREATER HILLTOP AREA COMMISSION RECOMMENDATION:  Approval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The site is located within the planning area of The Greater Hilltop Plan (2001), which recommends that inappropriately zoned parcels be rezoned so that they are consistent with current land use and surrounding uses. Since single-family and multi-family residential uses are predominant in this neighborhood, the current C-4, Commercial District could introduce incompatible land uses into the area.   The proposed R-3, Residential District is consistent with the Plan recommendation, and the zoning and development patterns of the area.

WHEREAS, application #Z06-052 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.69± acres from C-4, Commercial District, to R-3, Residential District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the Greater Hilltop Area Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the site is located within the planning area of The Greater Hilltop Plan (2001), which recommends that inappropriately zoned parcels be rezoned so that they are consistent with current land use and surrounding uses. Since single-family and multi-family residential uses are predominant in this neighborhood, the current C-4, Commercial District could introduce incompatible land uses into the area.   The proposed R-3, Residential District is consistent with the Plan recommendation, and the zoning and development patterns of the area, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

IN WESTGATE PARK SUBDIVISION
 
A tract of land lying within the boundaries of Westgate Park Subdivision as recorded in Plat Book 18 at Pages 10 and 11 in the Franklin County records and being owned by Anacleto Galli as recorded in Instrument 200001100006815 and being all of Lots 203 through 207 of Westgate Park Subdivision and more particularly described by metes and bounds as follows:
 
Beginning for reference at the point of intersection of the centerline of Derrer Road (40 feet) and Olive Street (50 feet) in Columbus, Ohio;
 
Thence North 01 degrees 59 minutes 40 seconds East along the centerline of Derrer Road 25.00 feet to a point;
 
Thence South 87 degrees 48 minutes 46 seconds East 20.00 feet to a 5/8 inch rebar set with cap stamped XYZ at the Southwest corner of Lot 207 of Westgate Park Subdivision for the True Point of Beginning;
 
Thence North 01 degrees 59 minutes 40 seconds East along the East line of Derrer Road and the West line of Lots 203 through 207, 250.00 feet to a 5/8 inch rebar set with cap stamped XYZ;
 
Thence leaving said Derrer Road South 87 degrees 48 minutes 46 seconds East 121.76 feet to a 5/8 inch rebar with cap stamped XYZ on the West line of a 16.00 foot alley;
 
Thence South 02 degrees 09 minutes 53 seconds West along the West line of said alley and the East line of Lots 203 through 207, 245.50 feet to a 5/8 inch rebar with cap stamped XYZ in the North line of Olive Street;
 
Thence South 89 degrees 09 minutes 31 seconds West along the North line of Olive Street, 85.14 feet to a point;
 
Thence North 87 degrees 48 minutes 46 seconds West along said North line 36.00 feet to the Point of Beginning.
 
Containing in all 0.692 acres all in Franklin County, Ohio.
 
The purpose of this legal description is to describe the outside boundaries of Lots 203 through 207 as shown in Plat Book 18 at Pages 10 and 11.

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the R-3, Residential District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
