Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Utilities to modify the contract with Messer Construction Company, in connection with the Sewer Maintenance Operations Center (SMOC) Renovations.
 
This contract provides for an extensive renovation and expansion of the Sewer Maintenance Operations Center (SMOC) on Fairwood Avenue.  The work includes constructing building addtions for office space and vehicle storage, demolition of building interiors and construction of new office space, renovation of building electrical and mechanical systems, installation of a surveillance laboratory and locker rooms, and improvements to parking areas, landscaping, utility services and security facilities.
 
This project is receiving financial assistance through the State of Ohio Water Pollution Control Loan Fund (WPCLF) loan CS392303-02, which is administered by the Ohio Environmental Protection Agency and the Ohio Water Development Authority.
 
2. CONSTRUCTION CONTRACT MODIFICATION:
The amount requested under this ordinance is $908,000.00. This modification provides funding for work to revise and furnish office space necessary to accommodate moving the Division's engineering personnel to the SMOC facility from other locations, and for numerous revisions to the work that are needed to provide a complete and safe facility of optimum utility.  The cost of the necessary additional work will be greater than the remaining contract contingency amount.  The funding requested by this ordinance is an estimate of the cost of the additional work, plus a contingency amount to allow for possible unforeseen work that may be needed for the office.  Any funding provided by this ordinance that is not needed will be cancelled from the Contract.
 
3.  FISCAL IMPACT:
$500,000.00 of this contract modification will be funded with Supplemental Loan No. 4318, from the Ohio Water Development Authority.  The remaining funds will be funded with proceeds from the unallocated balance of the Division of Sewerage and Drainage's Permanent Improvements Fund.
 
4.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting Council to pass this ordinance as an emergency measure.  This is necessary to assure the continuation of project work and a timely completion of this vital facility.

Body
WHEREAS, Contract No. EL003474 was executed by the Director of Public Utilities with Messer Construction Company, as authorized by Ordinance No. 0707-03, passed by Columbus City Council on May 5, 2003, to provide for construction of the Sewer Maintenance Operations Center (SMOC) Renovations; and
 
WHEREAS, Division of Sewerage and Drainage engineering personnel have determined it necessary to modify the contract with the Messer Construction Company in order to provide a fully functional facility and accommodate relocating Division of Sewerage and Drainage engineering personnel to the SMOC facility; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the appropriation and expenditure of funds; an amendment to the 2005 Capital Improvements Budget, pursuant to authorizing the Director of Public Utilities to modify the contract with Messer Construction Company which is necessary to allow for the prompt completion of the Sewer Maintenance Operations Center (SMOC) Renovation Project, at the earliest practicable date for the immediate preservation of the public health, peace, property, and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the Ohio Water Development Authority Loan No. CS392303-03 Supplemental Loan, for the Sewer Maintenance Operations Center (SMOC) Renovations Project; and funds from the unappropriated monies in Fund 666, the amount of $500,000.00 for the cost of this construction contract modification, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05| Fund No. 666| Object Level Three 6673| OCA Code 655380| Project Account 650510| $500,000.00.
 
Section 2.  That the City Auditor is hereby authorized and directed to appropriate a total of $408,000.00 from the Unallocated Balance of the Sewer System Permanent Improvements Fund No. 671, Project Account 671999.
 
Section 3.  That the City Auditor is hereby authorized and directed to transfer $408,000.00 from within the Sewer System Permanent Improvements Fund No. 671, for the Division of Sewerage and Drainage as follows:

Section 4.  That the Director of Public Utilities be and hereby is, authorized to execute a construction contract modification in the amount of $908,000.00 with Messer Construction Company, 3705 Business Park Drive, Columbus OH  43204-5007, in connection with the Sewer Maintenance Operations Center (SMOC) Renovations, in order to provide funding for additional work that is needed, in accordance with the terms and conditions as shown on the Modification on file in the office of the Division of Sewerage and Drainage.
 
Section 5.  That for the purpose of paying the cost of the construction contract modification, the expenditure of $908,000.00, or as much thereof as may be needed, is hereby authorized as follows:
