Title: To amend the 2006 CIB; to authorize the transfer of funds between projects within the 1995, 1999, 2004 Voted Streets and Highways Fund; to authorize its transfer to and appropriation within the Federal State Highway Engineering Fund; to authorize the City Attorney to expend an additional $300,000.00 for acquisition related activities including the acquisition of fee simple title and lesser interests in and to property needed for Phase 2 of the Morse Road Improvement project from the Federal State Highway Engineering Fund; and to declare an emergency. Explanation
 
The City of Columbus, Public Service Department, Transportation Division, is engaged in the Morse Road Improvement project.  The purpose of this project is to create a gateway into the Northland community by controlling vehicular access and circulation, enhancing landscaping, upgrading lighting and providing pedestrian access to the businesses and amenities located along the Morse Road corridor between Indianola Avenue and Cleveland Avenue.  Improvements contemplated by this project are a landscaped median, curb and gutters, street trees, sidewalks, improved streetlights and traffic signals and pedestrian crossing upgrades at intersections.  This project has been divided into two phases, Phase 1 from Indianola Avenue to Karl Road and Phase 2 from Karl Road to Cleveland Avenue.  Acquisitions and construction for Phase 1 have been completed.  The City is now engaged in the acquisition of those parcels needed for Phase 2 construction.  Ordinance 1762-2005 established preliminary funding in the amount of $1,000,000.00 for Phase 2 acquisition related activities and authorized the City Attorney's office to acquire the necessary parcels.  The City Attorney's Real Estate Division staff recently notified the Transportation Division an additional $300,000.00 would be required to complete acquisition of the right-of-way needed for Phase 2.  This legislation authorizes the City Attorney to expend an additional $300,000.00, or so much thereof as may be necessary, to complete acquisition of fee simple title and lesser interests in and to property needed for Phase 2 of this improvement project.
 
Fiscal Impact: Monies to pay for these costs are available within the 2006 CIB in the 1995, 1999, 2004 Voted Streets and Highways Fund.  This ordinance transfers the amount of these additional Right of Way costs to the Federal-State Highway Engineering Fund where it is appropriated and authorized for expenditure.
 
Emergency Justification: Emergency action is requested to allow the Real Estate Division to continue acquisition of the necessary right-of-way without delay so the City can proceed with the installation of the proposed improvements and upgrades as currently scheduled.

WHEREAS, the City of Columbus is engaged in the Morse Road Improvement project; and

WHEREAS, Ordinance 1763-2005, passed January 9, 2006, established initial funding in the amount of $1,000,000.00 for Phase 2 acquisition related activities; and
 
WHEREAS, the City Attorney's Real Estate Division staff recently notified the Transportation Division an additional $300,000.00 would be required to complete acquisition of the right-of-way needed for Phase 2 of this project; and
 
WHEREAS, the following legislation authorizes the City Attorney to expend an additional $300,000.00, or so much thereof as may be necessary to complete the acquisition of fee simple title and lesser interests in and to property needed for Phase 2 of this improvement project; and
 
WHEREAS, it is necessary to transfer monies within and between funds and appropriate it within the fund to which it has been transferred; and
 
WHEREAS, this ordinance amends the 2006 Capital Improvements Budget; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the additional funds necessary to complete acquisition related activities for this phase of this improvement project so that construction can begin without delay thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Attorney be and is hereby authorized to continue acquisition related activities necessary to complete acquisition of fee simple title and lesser interests in and to those parcels needed for the Morse Road Improvement Project, Phase 2, and to expend those funds required to pay related acquisition costs.
 
SECTION 2.  That the 2006 Capital Improvements Budget established within ordinance 1108-2006 be and hereby is amended as follows:

SECTION 6.  That the sum of $300,000.00 be and hereby is appropriated from the unappropriated balance of the Federal-State Highway Engineering Fund, Fund 765, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2007, to the Transportation Division, Department No. 59-09, Object Level One Code 06, Object Level Three Code 6601, OCA Code 596009 and Grant 596009.
 
SECTION 7.  That the funds appropriated in Section 6 shall be paid upon the order of the Public Service Director and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
SECTION 8.  That for the purpose of paying for said costs the City Attorney's Office is hereby authorized to expend an additional of $300,000.00, or so much thereof as may be necessary from Fund 765, the Federal-State Highway Engineering Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 596009, and Project 596009.
 
SECTION 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
