Explanation
Background:
This legislation authorizes a personal service contract with Southeast Inc. to provide a counselor to assist in the Witness Assistance Program in the City Attorney's Office. Council has budgeted for continuation of the program for the remainder of 2003 and 2004 with funding from the City's general fund.
The City Attorney has been contracting with Southeast Inc. or an employee thereof since 1986 and desires to continue the present relationship. Accordingly, a waiver of Columbus City Code ยง329.11 is sought.

Monies are available in the 2003 budget. This is a budgeted request.

To authorize and direct the City Attorney to enter into contract with Southeast Inc. for counseling and other professional services, to waive the provisions of competitive bidding and to authorize the expenditure of Twenty-five Thousand Five Hundred Dollars and 00/100 ($25,500.00), and to declare an emergency.
Body
WHEREAS, City Counsel has made funding available which will permit the City Attorney's Witness Assistance Program to contract with Southeast Inc. for assistance in counseling services; and
WHEREAS, the City Attorney has been contracting with Southeast Inc. or an employee thereof since 1986 and desires to continue the present relationship. Accordingly a waiver of Columbus City Code 329.11 is sought.
WHEREAS, an emergency exists in the usual daily operation of the City Attorney's Office, Prosecutor Division, in that it is immediately necessary to enter into this contract, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:
SECTION 1. That the City Attorney be and hereby is authorized to enter into a contact with Southeast Inc. for counseling and other professional services to be rendered in connection with the Witness Assistance Program in the City Attorney's Office.
SECTION 2. That City Council deems it to be in the best interest of the City to waive the provisions pertaining to competitive bidding in 329.11 of the Columbus City Codes, 1959, and the same are hereby waived for the purpose of entering into this contract.
SECTION 3. That the sum of Twenty-Five Thousand Five Hundred Dollars 00/100 ($25,500.00), or so much thereof as may be necessary is hereby authorized to be expended to pay the cost of said contract from:

SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approve by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
