Explanation

 

Background: This ordinance authorizes the Director of Recreation and Parks to enter into contract with Otis Elevator Company for elevator repair and modernization services. The amount being authorized by this ordinance is $115,540.00 and a contingency of $20,000, for a total of $135,540.00. The elevator at the Priscilla R. Tyson Cultural Arts Center is currently inoperable.  A vital component to the power systems of the elevator has broken down unexpectedly.  The elevator is inoperable until the systems are repaired.  Due to the age of the elevator, it is necessary to replace and modernize numerous components and systems to provide for safe operation.  The estimated lead time to perform necessary services is up to 18 weeks. Arts programming is ongoing at this facility. The facility is currently not accessible to all staff and participants, making this emergency repair critical.

 

Vendor Bid/Proposal Submissions:

 

The City has solicited informal proposals via the vendor services portal for elevator repair services according to RFQ033583.  The City received two written informal bid proposals from the following companies: 

 

Otis Elevator Company $115,540.00

Fujitec America, Inc. $143,235.00

 

After reviewing the bids that were submitted, Otis Elevator Company has been selected to provide elevator repair and modernization services.  It is necessary to waive competitive bidding provisions of City Code 329 to enter into contract with Otis Elevator Company for elevator repair services.

Emergency Justification: Emergency action is requested to immediately enter into contract to provide necessary repairs to the elevator at the Priscilla R. Tyson Cultural Arts Center, so the facility is accessible for all as soon as possible. Arts programming is ongoing at this facility. The facility is currently not accessible to all staff and participants, making this emergency repair critical.   

 

Benefits to the Public: This contract will provide necessary repairs and modernization to the elevator at the Priscilla R. Tyson Cultural Arts Center.  

 

Community Input/Issues: The community has expressed a desire for safe and well-maintained city facilities.

To authorize the Director of Recreation and Parks to enter into contract with Otis Elevator Company for elevator repair services; to waive the competitive bidding provisions of Columbus City Code Chapter 329; to authorize the expenditure of $135,540.00 from the Recreation and Parks Operating Fund; and to declare an emergency. Body

 

WHEREAS, it is necessary to authorize the Director of Recreation and Parks to enter into contract with Otis Elevator Company to provide elevator repair services; and

 

WHEREAS, it is in the best interest of the City of Columbus to waive the competitive bidding provisions of Columbus City Code Chapter 329 to enter into this contract; and

 

WHEREAS, it is necessary to establish an Auditor's certificate and authorize the expenditure of $135,540.00 from the Recreation and Parks Operating Fund 2285 per the accounting codes in the attachment to this ordinance; and

 

WHEREAS, an emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to authorize the Director to enter into contract with Otis Elevator Company for elevator repair services as arts programming is ongoing at this facility and the facility is currently not accessible to all staff and participants, making this emergency repair critical, all for the preservation of the public health, peace, property, safety, and welfare and, NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks is hereby authorized to enter into contract with Otis Elevator Company for elevator repair services.

 

SECTION 2. That this Council finds it in the best interest of the City of Columbus to waive the competitive bidding provisions of Columbus City Code Chapter 329.

 

SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contract or contract modifications associated with this ordinance.

 

SECTION 5. That the expenditure of $135,540.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Columbus Recreation and Parks Department Operating Fund 2285 per the accounting codes in the attachment to this ordinance.

 

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
