Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to reimburse the Division of Transportation for storm sewer improvements in connection with their Lane Avenue Roadway Improvements Project. The Division of Transportation agreed to construct a 60-inch diameter storm sewer and related work. The design of this project occurred several years ago, and there was evidently no storm project created or encumbrance established to pay for this work.
2. FISCAL IMPACT:
The project account from which funds are being transferred from within this ordinance are from the Voted Storm Sewer Bond Fund; and legislation will amend the 2006 Capital Improvements Budget to provide sufficient budget authority. The Division is requesting a transfer of funds in order to reimburse the Division of Transportation for the storm sewer improvements they installed as a part of their Lane Avenue Roadway Improvements Project.

WHEREAS, the Division of Transportation, at the request of the Division of Sewerage and Drainage, Department of Public Utilities has incorporated the construction of storm sewer improvements into the Lane Avenue Roadway Project; and
WHEREAS, Ordinance No. 1416-2006, passed September 11, 2006 authorized the Director of Public Service to enter into contract with Nickolas Savko and Sons, Incorporated, for construction of the Lane Avenue Improvement project for the Transportation Division; and
WHEREAS, the aforementioned construction project has been completed, and it is necessary for this City Council to authorize the City Auditor to transfer the required funds that are necessary to allow the Director of Public Utilities to reimburse the Division of Transportation for the documented construction costs associated with the storm sewer improvements; at the earliest practicable date; and
WHEREAS, is is necessary to authorize an amendment to the 2006 Capital Improvements Budget for purposes of providing sufficient budget authority for the aforementioned project expenditure; now, therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized and directed to transfer $1,086,660.50 from within the Voted Storm Sewer Bond Fund No. 685, for the Division of Sewerage and Drainage as follows:

Section 2. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 3. That the Director of Public Utilities is authorized to reimburse the Division of Transportation for the documented construction costs of a 60-inch diameter storm sewer and related work in connection with the Lane Avenue Storm Sewer Improvements Project.
Section 4. For the purpose of reimbursing the Division of Transportation for the construction services referenced within Section 3 herein, the expenditure of $1,086,660.50 is hereby authorized from within the Voted Storm Sewer Bond Fund No. 685| Div.: 60-15| Project: Lane Avenue Storm Sewer Improvements | Project No. 611005| OCA Code 685005| Object Level Three No. 6630| Amount: $1,086,660.50.
Section 5. That the 2006 Capital Improvements Budget Ordinance No. 1108-2006 is hereby amended as follows, to provide sufficient budget authority for the execution of the reimbursement stated in Section 3 herein.
