Explanation
The purpose of this legislation is to authorize the City Attorney on behalf of the Director of Public Utilities to modify an existing agreement with Burgess and Niple for the continued use of Burgess and Niple as a consultant relative to the Whims Ditch lawsuit Marshal v. Columbus.
The City Attorney's Office entered into an agreement on behalf of the Division of Sewerage and Drainage with Burgess and Niple on November 27, 2007 for professional consulting work pertaining to the Whims Ditch lawsuit. ED-034628 was established in the amount $20,000.00.
It has become necessary to modify and increase ED-034628 for continued consulting services with Burgess and Niple relative to the case Marshal v. Columbus. The request of this ordinance is $15,000.00. This modification does not change the scope of service which includes review of case material, review of plaintiff's reports, preparation of deposition questions, giving expert witness testimony and identifying and reviewing stormwater regulations.
FISCAL IMPACT: $15,000.00 is needed for this service

Emergency legislation is being requested so that there is not any interruption in consulting services for this case.

WHEREAS, the City Attorney's Office entered into an agreement on behalf of the Division of Sewerage and Drainage with Burgess and Niple on November 27, 2007 for professional consulting work pertaining to the Whims Ditch lawsuit. ED-034628 was established in the amount $20,000.00, and
WHEREAS, It has become necessary to modify and increase ED-034628 for continued consulting services relative to the case Marshal v. Columbus, and
WHEREAS, This modification does not change the scope of service which includes review of case material, review of plaintiff's reports, preparation of deposition questions, giving expert witness testimony and identifying and reviewing stormwater regulations, and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to modify and increase an existing agreement with Burgess and Niple so that there is not any interruption in services for the immediate preservation of the public health, peace, property and safety; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Attorney be and is hereby authorized to modify and increase and existing agreement with Burgess and Niple for Division of Sewerage and Drainage for Consulting Services relative to the Whims Ditch lawsuit.
Section 2. That the expenditure of $15,000.00 or so much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund No. 650

Section 3. That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
