Explanation
Background:
This ordinance will authorize the Director of Recreation and Parks to enter into a contract with The Active Network, LTD for the Class Software Program.
Services include on-site training of the Class software program utilized for scheduling, registration and payment tracking, and for remote account and membership import.
Contract will be for services from August 14, 2006, through August 18, 2006, and will include forty (40) hoursof on-site training and account/membership import.
The Contract Compliance Number for The Active Network, LTD is #980160721 001.
In 2006 a purchase order in the amount of $8,600.00 was issued for services to provide on-site training for staff. However, during the training period the consultant determined that the data in the system was corrupt and would require a complete rebuild of the database. The combination of this previous purchase order and the services to be rendered, $16,400, will necessitate legislation.
The department is requesting the waiver of the formal bidding provisions of the Columbus City Codes to enter into a contract with The Active Netwowrk, LTD due to the proprietary nature of the software, unique skills, abilities and teaching experience required for this software.
Emergency action is necessary to have funding available for necessary expenditures.
Fiscal Impact:
$16,400.00 is required and budgeted in the Recreation and Parks Operating Fund to meet the financial obligation of this contract.
Title
To authorize and direct the Director of Recreation and Parks to enter into contract with The Active Network, LTD for on-site training of the Class Software Program, to waive competitive bidding requirements, to authorize the expenditure of $16,400.00 from the Recreation and Parks Operating Fund, and to declare an emergency. ($16,400.00)
Body
WHEREAS, it is in the best interest of the City of Columbus to waive the requirements of competitive bidding and contract with The Active Network, LTD for on-site training of the Class Software Program; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract to have funding available for necessary expenditures; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That this Council finds it in the best interest of the City of Columbus to waive requirements of competitive bidding for professional services for the Class Software Program, and does hereby waive provisions of Section 329.06(b) of the Columbus City Codes.
Section 2. That the Director of Recreation and Parks be and is hereby authorized and directed to enter into contract with The Active Network, LTD for the Class Software Program.
Section 3. That the expenditure of $16,400.00, or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Operating Fund No.285, Dept. 51-01, OCA Code 510289, and Object Level 3 No. 3336, to pay the cost thereof.
Section 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
